Tribunal Ruling Highlights Importance of Compliance for Recruitment Agencies

We’re not out of January yet, and the first big story to shake up the temp recruitment sector has already made headlines.

A recent Employment Tribunal found that a recruitment agency unlawfully deducted £37,000 from the earnings of a contractor providing services to the Home Office through their own limited company, otherwise known as a personal service company (PSC).

The Home Office determined that the assignment was inside IR35, so the agency deducted PAYE deductions, including the employer's National Insurance Contributions (NIC), from the contractor’s rate. However, the tribunal found that the employer’s NICs were the legal responsibility of the agency rather than the contractor and had been deducted unlawfully.

Whilst the agency appeared to be acting in good faith (it had paid the deductions to HMRC in line with UK tax and PAYE law), its case appears to have been undermined by a lack of clear communication and contractual terms.

The case underscores the need for recruitment agencies to remain fully compliant with employment laws and regulations, particularly under the Off-Payroll Working Rules (IR35).
