Transitional Arrangements Reminder for Qualifying Higher-Risk Building Projects

The Building Safety Regulator (BSR) is reminding the construction industry about the provisions being made in order for higher-risk building projects to stay under their existing building control regime.

Projects must be eligible to remain, and developers must take certain steps for their project to qualify for eligibility. If developers fail to do so, the project will be transferred to the BSR.

To qualify for transitional provisions:

  • The project will have had building control arrangements established before 1 October 2023 and will have made substantial progress before 6 April 2024.
  • It will also require the current building control provider to be registered with the BSR.

To benefit, developers must take the following actions:

  • Give notice to the relevant local authority, explaining the sufficient progress the project has made.
  • Offer a copy of this notice to the Approved Inspector (AI) if appropriate.
  • Ensure the project is using a registered building inspector (RBI).
