TOP 10 WAYS TO FIGHT THE VETERANS AFFAIRS (VA)  :

(... GIVEN MY 360 DEGREES OF WISDOM ON THIS AS A PROFESSIONAL, EXECUTIVE, PHYSICIAN, VETERAN, WOUNDED WARRIOR & VICTIM OF THE MIAMI VA) 

This article should NOT BE CONFUSED with my "TOP 30 WAYS TO FIX THE VA'S PRIORITY PROBLEMS" -----> THAT IS A DIFFERENT TOPIC, ARTICLE & TESTIMONY BY MYSELF IN 2017 IN D.C. (Looking foreword to that day). 

"FIGHTING" THE VA AS A VETERAN & "FIXING" THE VA ARE SEPARATE BUT SHARE MANY OF THE SAME FEATURES.

*****  I AM HOPING THAT DISCUSSIONS OF PUTTING ME IN THE TOP D.C. TIER TO "FIX THE VA" NEXT YEAR COME TRUE. (PRAYING) 

1. File an "ETHICS" complaint with the PROFESSIONAL board that oversees any VA employee doing wrong (ethical abuse is usual involved). This has NOTHING TO DO WITH THE "VA DOME OF PROTECTION" .

2. The "Federal Tort Claims Act" & "VA DOME OF PROTECTION" have MANY "holes" in it to reach $1 MILLION-$50 MIL settlements (HENCE WHY VA "SETTLEMENTS" ARE SKYROCKETING RIGHT NOW)  , depending on the case; utilize a lawyer quickly without signing anything, allowing the VA OIG to jump through their BS steps (save all documentation) & INITIALLY bring EVERY party involved into the lawsuit (nurses, NPs, Administrators, etc...-- keep docket of WHO INVOLVED).

Also, keep in mind that IF the CIRCUMSTANCES of any claim have CHANGED , such as shown fraud, waste & abuse ....then the "STATUTE OF LIMITATIONS" CAN CHANGE; especially after all that has happened in the last eight years with the 'VA'

*****   I AM SURPRISED LAWYERS ARE NOT REOPENING VETERAN CASES SINCE THE VA OIG WAS & SEVERAL 'LOWER CLAIMS/HOSP. ADMINISTRATORS' HAVE RECENTLY BEEN FOUND GUILTY OF AT LEAST ABUSE / FRAUD OR INCOMPETENCE AT VARYING LEVELS ....& WAS EVEN REPLACED.

3. Unless you are 'Active Duty', ANYONE can sue the VA system or entity connected just like any normal hospital/company; your lawyer must be wise to poke holes UPWARD. 

*****  I strongly recommend that Congress turn the Veterans Affairs (VA) into a Federal based "Co-Op", similar to the "TENNESSEE VALLEY AUTHORITY", where the Federal Government is still responsible for all funding & coordination (THAT IS IT), BUT the PRIVATE "CO-OP" manages EVERYTHING ELSE at every level down to the volunteer door greeters with the FULL POWER TO HIRE, FIRE & PROMOTE based on basic CIVILIAN laws of employment.... = ACCOUNTABILITY !

4. Remember all "statutes of limitations" for VA, Civil & Federal claim.

5. Once this administration is gone, good FBI agents will again be FREE to HELP a Veteran who is a "FIELD GRADE OFFICER" or "SENIOR NCO" with certain statuses with their cases.(UNDER UCMJ PROTECTIONS).

Also, in the YEARS TO COME (IF CHANGE), the STATE LEADERS around our nation who are LAWYERS, should come together as a POWERFUL GROUP to re-due the entire process of "VA Claims", "VA Claim Reviews/appeals", "VA Boards of Appeal", etc................... possibly even take over those duties in the courts of every state ! (thinking outside the box !)

.......we are talking about a group of society who deserves EVERY INCH OF HELP FROM LAWYERS, PHYSICIANS, CONGRESS, & LEADERS POSSIBLE..................Veterans./

(come from BOTH major parties = should be non-partisan!)

6. Call in ALL media for EXPOSURE (sometimes the tiny media market can EXPAND)

7. Don't miss filling out any standard VA issued forms, but let LEGAL COUNSEL help; remember, multiple of the "Veteran Service Groups" in D.C. are on the SAME HALLWAY with the VA PEOPLE in D.C. (even stated &/or documented eating lunch/dinner together by multiple accounts = VIOLATION OF THE LAW -- Will not last under NEW / proper POTUS -- TRUST ME.......... )

8. Go to actual Federal Appeals Judges for personal help if needed (they can get far more done than a Congressman in most cases. The several judges that I know/talk with all tell me that they are SURPRISED that Veterans with OUTRAGEOUS VA CASES don't come to them more often; they can help you without you even hiring a lawyer IF NEEDED. (their law clerks are the first contact across the nation).

*****  The next POTUS should sign this as an 'EXECUTIVE ORDER' FOR ALL FEDERAL JUDGES TO DO A BRIEF REVIEW OF ANY UNUSUAL CASES PRESENTED TO THEM FOR POSSIBLE PULLING OF THAT CASE STRAIGHT FROM THE "VA DOME OF BS" INTO THE CIVILIAN FEDERAL COURTS. (THIS ALONE WOULD SOLVE HUGE AMOUNTS OF VETERAN PROBLEMS)

9. If the VA has become a 'Hostile Entity' toward you, give them WRITTEN "LEGAL DUE NOTICE" of such & then proceed.

Remember , you can take any VA Judge, Physician, Nurse, Administrator, etc... before their "ETHICS COMMITTEE" & request review AND movement of your case to a Federal Court ASAP.

10. If you are a WORKER, VOLUNTEER, etc... of any entity , including the VA, if you fear for your job (Volunteers should never fear for their job if VETERAN LIVES ARE AT STAKE), then GO TO MEDIA REPORTERS, WATCHDOG GROUPS (LIKE JUDICIAL WATCH - IF YOU DON'T WANT TO NOTIFY ME), they will take the ball and run without revealing your name or their "sources". ...
