The TikTok Ban: A Threat to Free Speech?

Dear Thought Leaders,

TikTok is everywhere: from teenagers perfecting their dance moves to CEOs breaking down quarterly reports in 60 seconds. But now, TikTok is at the heart of a fiery national debate about freedom, security, and the very fabric of the First Amendment.

This isn't just about a social media app—it's about the American ideal of free expression.

Is the government justified in its pursuit of restrictions, or are we witnessing an overreach that chips away at the foundations of democracy?

Let’s break it down.

The Government’s Case: National Security or a Trojan Horse?

TikTok is owned by ByteDance, a Chinese company operating under China’s strict surveillance laws. According to the U.S. government, this creates an inherent national security risk. The fear is that the Chinese Communist Party (CCP) could access TikTok's vast data trove—billions of user profiles, preferences, and geolocations.

The FBI and Department of Justice have raised alarms, citing concerns over espionage and influence operations.

Senator Josh Hawley famously said, "China is not our friend, and anything that gives them a foothold on American soil is a threat to our sovereignty."

Adding to this, ByteDance employees were found in 2022 to have improperly accessed data on U.S. journalists. The incident confirmed fears that TikTok’s data practices are not airtight, fueling bipartisan calls for a ban.

The government argues that TikTok is not just an app—it’s a potential Trojan horse.

By mining user data, it could allow foreign powers to shape narratives or even target individuals. In an era of disinformation campaigns and cyber warfare, these concerns carry weight.

The Case for Freedom: What About the First Amendment?

But here's the kicker: TikTok isn’t just a data collection app.

It's a platform where millions of Americans exercise their freedom of expression.

Under the First Amendment, speech on TikTok—whether it’s political commentary, comedic sketches, or grassroots activism—is protected.

Restricting or banning TikTok raises profound questions:


  • Is the government infringing on free speech? Blocking access to the platform could be seen as censoring an entire avenue of expression.
  • Who decides what constitutes a threat? Critics argue that banning TikTok sets a dangerous precedent, allowing the government to shut down platforms it deems risky.


Harvard Law professor Laurence Tribe put it bluntly: “Banning TikTok would be an unprecedented violation of Americans’ constitutional rights. We cannot sacrifice freedom for the illusion of security.”

The Threat

To play devil’s advocate, let’s acknowledge that the First Amendment is not absolute. Courts have ruled that national security can justify certain restrictions on speech—such as the famous Pentagon Papers case.

If TikTok poses a tangible, demonstrable threat to U.S. security, a ban could, in theory, pass constitutional muster.

Moreover, tech policy experts warn that TikTok’s algorithm, fine-tuned by Chinese engineers, could manipulate U.S. political discourse. Imagine an election season where foreign actors tweak the algorithm to suppress certain viewpoints while amplifying divisive rhetoric.

The potential for harm extends far beyond data collection.

The Rebuttal: Why Freedom Must Win

But even if we grant the government’s concerns, does banning TikTok truly solve the problem? The answer is a resounding no.


  1. If you put it out there, so what? TikTok doesn’t collect data fundamentally different from other apps like Facebook or Instagram. The real issue is how that data is used. Instead of banning TikTok, why not demand stricter transparency laws for all tech companies, foreign and domestic?
  2. Freedom isn’t safe, but it’s worth it. The First Amendment guarantees Americans the right to free speech—even when that speech occurs on a platform owned by a foreign entity. Suppressing TikTok could pave the way for more censorship.


What happens when a future administration decides Twitter or YouTube poses a threat?

Banning TikTok could hurt America’s image as a leader of the free world. Other democracies—like the UK and Canada—have found ways to mitigate security risks without infringing on individual freedoms.

Why can’t we?

The Bigger Picture: A Lesson in Resilience

As Americans, we thrive on resilience and ingenuity. Instead of banning TikTok, let’s focus on teaching digital literacy, strengthening cybersecurity, and promoting transparency in data practices.

The solution to foreign interference isn’t shutting down platforms—it’s empowering citizens to navigate them wisely.

This debate isn’t just about an app. It’s about who we are as a nation.

Are we so fearful of external threats that we’ll sacrifice the freedoms that define us?

Or will we stand firm, acknowledging that freedom comes with risks but remains the cornerstone of our democracy?

Final Thought: The Flame of Freedom

In a time of uncertainty, it’s tempting to trade freedom for security. But history teaches us that this trade-off rarely ends well.

Let TikTok remind us that the First Amendment isn’t just a privilege—it’s a responsibility. And in defending it, we protect not just our rights, but the soul of America.

The actions taken by the Biden administration regarding #TikTok indicate that economic freedom is now viewed through the lens of American geopolitical strategy. One might chuckle at the irony that a nation positioning itself as the guardian of the so-called ‘free world’ seems more focused on its own geopolitical interests than on the principles it professes. This underscores the idea that what is acceptable for one country (like China) may not be for another (like the U.S.), revealing the double standards often present in international relations. In this sense, the definition of a free market becomes contingent on American geopolitical considerations rather than being a universal principle. As the lines blur between market freedoms and political interventions, one must wonder: is it truly a free market when the rules change based on who holds the reins of power? …when the guardian of the 'free world' rewrites the rules, ‘freedom’often wears a double mask ??
