Three Business Trends That All Legal and Dispute Resolution Professionals Need to Be Aware of for 2025

2025 marks the halfway point of a decade that’s already brought profound upheaval and transformation across technology, politics, and society.

As we approach the second half of the decade, the pace of disruption shows no signs of slowing down. For those wanting to survive and thrive in today’s business environment, it’s critical to understand the trends driving this dynamic convergence of innovation, threats, and opportunities.

This is why each year I highlight what I believe will be the most impactful trends for the year ahead. Understanding these is vital for anyone aiming to leverage them for growth and competitive edge. So, here’s my overview of the key trends shaping business in the coming year, and how they apply specifically to dispute resolution and legal professionals.

Getting Strategic With Generative AI

We’ve spent the last couple of years being wowed by the potential of generative AI and hearing about how it’s going to change the world. But 2025 is the year I believe we will start to see organizations move beyond the hype and start integrating generative AI into business strategy in meaningful ways.

During the previous wave of AI transformation, businesses like Google, Amazon, and Netflix rethought their strategy from the ground up to center around deep learning. By doing this, they transformed existing business models such as online advertising, retail, and media streaming.

Similarly, 2025 will mark the moment when generative AI becomes a cornerstone for strategic growth in the legal and dispute resolution sectors. Rather than merely adding AI-powered features like chatbots or document generators, professionals will start using AI to reshape their business models and workflows.

Here are three concrete examples of how this will manifest:

  1. AI-Assisted Case Preparation: Legal professionals will use AI tools to quickly analyze large volumes of documents, case law, and precedents. Generative AI will draft initial pleadings, briefs, or mediation summaries, allowing professionals to dedicate more time to high-level strategy and client engagement.
  2. Predictive Outcome Analysis: AI platforms can analyze similar cases and offer real-time predictive insights into outcomes, potential settlements, or mediation agreements. This will allow mediators and attorneys to make more informed recommendations, helping clients achieve optimal outcomes.
  3. Customized Mediation Simulations: Generative AI can simulate dispute resolution scenarios, allowing mediators and lawyers to rehearse negotiations. By adjusting factors like party demands or offers, professionals will be better prepared for the nuances of real-life sessions.

As generative AI’s capabilities grow, professionals who embrace its strategic potential will gain a competitive edge, offering innovative, client-centric solutions that were previously unimaginable.

Customer Experience Is King

In 2025, customer experience (CX) will increasingly be seen as the key differentiator between competing providers of goods and services. As markets mature and buyers become more discerning, businesses that excel in delivering friction-free, hyper-personalized, and memorable experiences will find themselves rising above the competition.

For dispute resolution and legal professionals, this trend is equally powerful. Clients are no longer satisfied with just strong legal outcomes—they expect seamless, personalized interactions and services tailored to their needs. AI and data analytics allow professionals to gather deeper insights into client preferences and behaviors, making it possible to offer “hyper-personalization at scale.”

Here are three ways that client-centered experiences will shape legal practice in 2025:

  1. Digital Dispute Resolution Platforms: Offering clients access to digital platforms where they can track case progress, upload documents, and securely communicate with their attorney or mediator will be key. These tools provide transparency and ease, enhancing clients’ control and comfort in the dispute resolution process.
  2. Tailored Virtual Mediation Sessions: As remote and hybrid work models continue, professionals will need to offer flexible virtual mediation or arbitration sessions. Using AI-driven scheduling and session formats that are customized to fit client preferences will set successful practitioners apart.
  3. Proactive Communication: Legal professionals can use AI-powered CRM systems to track client concerns and preferences, allowing for personalized communication and follow-ups before clients even ask for updates. Anticipating client needs will help build stronger relationships and trust.

The professionals who place client experience at the center of their practice will see greater client loyalty, referrals, and long-term success.

Resilience In The Age Of Uncertainty

To say that we face uncertainty around economic conditions and matters of international security as we enter 2025 is an understatement. Ongoing conflicts in regions like Ukraine and the Middle East, alongside economic uncertainty and fluctuating market conditions, are creating challenges for businesses across the globe. The need for organizations to develop resilience—the capacity to survive and adapt to disruptions—will be a key talking point for the year ahead.

For dispute resolution and legal professionals, building resilience means preparing for the unexpected and being able to pivot rapidly when needed. This requires a proactive approach to mitigating risks and ensuring continuity of services.

Here are three examples of how resilience will be built into legal practices in 2025:

  1. Remote Dispute Resolution Solutions: Offering fully remote mediation and arbitration services can help professionals maintain continuity during disruptions caused by travel restrictions or global crises. Remote solutions ensure that clients can continue resolving disputes no matter the circumstances.
  2. Cross-Border Legal Networks: By establishing international partnerships with other mediators and law firms, legal professionals can navigate geopolitical risks and offer clients solutions in cross-border disputes. This adaptability allows firms to continue operating despite disruptions in different regions.
  3. Scenario-Based Risk Management: AI tools can simulate potential disruptions—such as economic downturns or legal changes—and model their impacts on a firm’s operations. Dispute resolution professionals can then adjust their approach proactively, offering alternative solutions to clients when crises emerge.

Resilience in 2025 will be about more than just surviving—it will be about thriving in an increasingly complex and unpredictable world.

By understanding and preparing for these key trends—strategic integration of generative AI, prioritizing customer experience, and building resilience—dispute resolution and legal professionals can stay ahead of the curve and turn potential challenges into opportunities for growth and success.

Great piece Susan! I think pace and evenness of adoption of AI is something to watch in 2025. I think you'll have early adopters leveraging GenAI tools to generate high-quality work product faster than their adversaries who may not be. For example, we're already seeing firms conducting full-scale first-round document reviews and having eyes on hot documents within days of review. If it's taking their opponents months to get to the same place, they will be at a significant advantage in understanding the dynamics of the case and pursuing winning strategies.
