In the case of Walton Global Investments Ltd. v Bowman Consulting Group Ltd 2023 U.S. Dist. LEXIS 108612 (E.D. Va. June 22,2023) The trial court dismissed the claim if the purchaser’s affiliated entity in a claim against the Engineer who took the position that the affiliate was not a party to the professional services agreement.? The affiliate argued that they were a third-party beneficiary to the contract, but the court found that simply being an entity related to the purchaser was not enough to state a viable third-party beneficiary claim in VA.
