Theft Of Liberty
Food For Thought
Since to formation of the United States we have always known that sooner or later someone would try top steal our liberty.
This is evidenced by the writing of those who actually framed the constitution and those others who served our country from the foundation.
.He that would make his own liberty secure, must guard even his enemy from opposition. -
Thomas Paine
They that can give up essential liberty to obtain a little temporary safety deserve neither liberty nor safety. -Benjamin Franklin
I believe there are more instances of the abridgment of the freedom of the people by gradual and silent encroachments of those in power than by violent and sudden usurpation's. -James Madison
Some very distinct areas that have been invaded are the deepest seated in our Constitution.
The constitution lays out what powers the Federal Judiciary have. Now, states have held for some time now that citizens can not sue the state. This was not so until this right was taken from the people, not by the constitution but by the courts and the states.
Section 2.
“The judicial power shall extend to all cases, in law and equity, arising under this Constitution, the laws of the United States, and treaties made, or which shall be made, under their authority;--to all cases affecting ambassadors, other public ministers and consuls;--to all cases of admiralty and maritime jurisdiction;--to controversies to which the United States shall be a party;--to controversies between two or more states;--between a state and citizens of another state;--between citizens of different states;--between citizens of the same state claiming lands under grants of different states, and between a state, or the citizens thereof, and foreign states, citizens or subjects.”
As defined in Section one, the judicial power of the United States is vested in the Supreme Court.
This simply says for example that when a citizen sues the state where they are a resident, the Supreme Court has the last word .
The eleventh amendment was needed to define how states were able to deal with suits from citizens of other states and foreign states. It is an exclusionary clause, but it is not an exclusion against citizens suing the state that they reside in. That right is guaranteed in the first amendment right to redress.
The 11th amendment says, “
Amendment XI
The judicial power of the United States shall not be construed to extend to any suit in law or equity, commenced or prosecuted against one of the United States by citizens of another state, or by citizens or subjects of any foreign state.”
In essence, over time, the Judiciary has become a political entity which has transferred great power from the People to the states and to the Federal government.
The three distinct branches of government are intended to be checks on each other, however when we allow any individual branch to over step the authority given it by the constitution, we will lose liberty. Not if, but will.
Political parties have convinced the People that political Agendas are the will of the People. This could not possibly be further from the truth.
When People say, “ well I think I will vote for this person because they believe more like I believe,” this is not the will of the People. It is the advertised will of the political party that most reasonable people have to come to understand is NOT what the party actually intends to do.
“At the establishment of our constitutions, the judiciary bodies were supposed to be the most helpless and harmless members of the government. Experience, however, soon showed in what way they were to become the most dangerous; that the insufficiency of the means provided for their removal gave them a freehold and irresponsibility in office; that their decisions, seeming to concern individual suitors only, pass silent and unheeded by the public at large; that these decisions, nevertheless, become law by precedent, sapping, by little and little, the foundations of the constitution, and working its change by construction, before any one has perceived that that invisible and helpless worm has been busily employed in consuming its substance. In truth, man is not made to be trusted for life, if secured against all liability to account.” - Thomas Jefferson
The will of most People is simple. The be able to live free and make their own decisions. To be able to raise their children in a safe environment. To be able to provide for their families without having to work them selves to death leaving no time to spend with their families. To be able to peruse happiness and exercise personal liberty as long as it does not deprive others of their rights.
Perhaps we have not been clear about our will to our Representatives.
