These cases illustrate the rights and remedies available to trademark and copyright owners. Decisions in favour of proprietors demonstrate the manner in which timely initiation of legal proceedings can be beneficial, whether against infringers or incorrect orders of the trademarks office. Courts have issued injunctions based on unregistered but reputed trademarks, and explained the scope of protection for well-known trademarks. Further, the court also clarified that the information technology laws and not the DMCA would apply to online copyright infringement and piracy in India.
