Supporting Success Behind the Scenes: Reflections on My Role in a High Court Application

I recently had the opportunity to attend a hearing in the King’s Bench Division in my capacity for the instructing solicitors at De Jure Chambers. The matter concerned an application under CPR r.42.3 to withdraw as legal representatives for a claimant due to non-payment of fees and a lack of instructions. While the firm was formally represented by a Specialist Costs Barrister, my role in supporting the preparation and execution of the application was a key component of the success achieved.
Meticulous Preparation and Compliance
A central aspect of my role involved preparing the N244 application and the supporting evidence. This required a detailed account of the firm’s extensive attempts to communicate with the claimant, as well as compliance with the procedural requirements under the Civil Procedure Rules. The submissions demonstrated the claimant’s repeated failure to engage, despite ample notice and reminders.
The thorough preparation of the application proved invaluable during the hearing. When the Judge sought confirmation that the claimant had been properly notified of the proceedings, I was able to provide supporting evidence promptly, including forwarding relevant email correspondence to the Judge and his clerk during the hearing.
The Outcome: A Testament to Teamwork and Diligence
The court granted the application, allowing the firm to withdraw as the claimant’s legal representatives, and awarded costs associated with the application. The ruling underscored the importance of clear and comprehensive submissions, as well as the procedural diligence that formed the foundation of the case.
It was gratifying to hear the Judge commend the clarity and precision of the evidence provided, which ultimately left no room for doubt about the validity of the application.

Reflections
This experience has reinforced the critical role paralegals play in the legal profession. While much of our work is conducted behind the scenes, it is integral to the smooth functioning and success of the legal teams we support.
The preparation and organisation of evidence, meticulous compliance with procedural rules, and ability to respond swiftly to developments in court are skills that paralegals bring to the table, ensuring that solicitors and counsel are equipped to achieve favourable outcomes.
