Subpoena Serving an Elusive Nurse

Subpoena serving can be a challenging task, especially when dealing with individuals who go to great lengths to evade it. A subpoena is a written order that forces the receiver to attend court and testify. Subpoena serving is similar to process serving, in which a lawyer or private investigator will locate a person and give them papers. In Illinois, avoiding a subpoena can result in a fine or jail time. In this recent RGH Investigations case, a creative and elusive nurse tries to protect her workplace and almost avoids the subpoena by having her husband and daughter cover for her. So, why was she avoiding the subpoena? And how did RGH Investigations eventually locate her?

An Obvious Evasion

Every attempt made by RGH Investigations to serve the nurse with the subpoena was met with resistance. Each time we approached her residence, the nurse’s husband or daughter would answer the door. They would abruptly end the conversation and slam the door shut. The nurse would conveniently never be home. It became increasingly apparent that the nurse was purposely avoiding the subpoena. The investigators who were subpoena serving, guessed that the nurse was hiding in the garage, or maybe in the car. RGH investigators decided to take further measures to follow the husband, not the nurse. This way, they wouldn’t see the investigators coming, and would be caught off guard.?

The Plan to Follow the Husband

Determined to serve the nurse with the subpoena, RGH investigations sent two investigators to aid in their search. One investigator knocked on the nurse's door, while the other waited outside the house, giving the impression that no one would follow the nurse or her husband. The husband answered the door and told the investigator that his wife wasn’t home. About 1 hour after the investigator knocked on the door and left, the husband got into the car and began to drive away. Another investigator stationed down the road began to follow their car.?

The China Buffet

After driving for about fifteen minutes, the husband arrived at a China buffet. The investigator following the car pulled into a China buffet restaurant. There, he saw the nurse pop up from behind the car’s back seats. The investigator approached the nurse before she entered the restaurant and served her with the subpoena. It seems as if the nurse was trying to avoid the subpoena to protect her workplace. She took great measures to avoid detection.The hospital was being sued for medical malpractice, and the nurse may have had some critical information that would be instrumental in the case.?
