Congratulations! The 17th of August has passed, and we’re all still here, adapting to the new real estate landscape under the NAR settlement. My name is Michael Cheever, and over my 23-year real estate career, I’ve gone from zero in production to netting over a million dollars, transitioning from a single producer to running a large team, and now serving as the General Manager of The Rawls Group.

Last week, I had the privilege of attending a high-level mastermind session where a compliance broker with inside knowledge of NAR shared valuable insights. What stood out to me most was the emphasis on: ensuring compliance with not only action but the spirit of the NAR settlement.

So, what is this "spirit" of the settlement? In my opinion, it’s about one core principle: transparency. Human beings thrive on certainty, simplicity, and clarity, and when those elements are missing, fear can take hold. Transparency is what dispels the fear of the unknown and brings us back to a place of confidence and clarity.

Buyer Brokerage Agreement and Transparency in Compensation

One key requirement under the NAR settlement is that the buyer brokerage agreement must be signed by all parties before showing a property, whether virtually or in person. This transparency around compensation brings clarity to the buyer from the very beginning of their home-buying journey.

For the buyer, understanding the value their agent brings to the table, the timeline of their purchase, and the budget needed helps simplify a complex and often emotional process. By laying everything out clearly, we create certainty for the buyer, empowering them to make informed decisions.

Listing Agents and Offers of Cooperative Compensation

Another significant change is that offers of cooperative compensation can no longer be publicly posted on Realtor-owned MLSs. At first glance, this may seem counterintuitive to the goal of transparency, but in reality, it’s about giving sellers more control and clarity.

For many years, sellers have assumed they must offer cooperative compensation. Now, they have the choice to either offer it, consider it with an offer, or decide not to offer it at all.

This conversation with sellers brings transparency to their side of the transaction, helping them understand how the market operates and what they’re competing against.

Sellers need to be aware of how their decisions on cooperative compensation can affect the visibility of their property. Some buyers, particularly those who are financially limited, may instruct their agents not to show them properties that don’t offer a predetermined level of compensation. This means fewer eyes on the property, potentially limiting offers.

By guiding your sellers with transparency about market conditions and compensation strategies, you help them make informed decisions that can position their property for success.
