???? Spanish data privacy in the spotlight

Each month, the team at Didomi compiles the essential information to help you stay in touch with our work and the privacy industry: top articles and guides, data insights, opinion pieces from industry experts, and curation of the best privacy publications online. Have a good read.

TL;DR: To help bring clarity and actionable data for organizations amidst regulatory changes, Didomi released a new benchmark looking at consent collection in Spain in 2024. Additionally, our VP Strategy presents the concept of consent lineage, and we take a comprehensive look at the ongoing legal saga between the TCF and the Belgian APD.

The IAB TCF and Belgian APD legal saga explained

Two years ago, Belgium's data protection authority, the Autorité de protection des données - Gegevensbeschermingsautoriteit , challenged IAB Europe 's Transparency and Consent Framework (TCF).

A lot has happened since then, and as legal proceedings continue to go forward, we figured it was a good time to reflect on the past two years and everything that has happened. As our Chief Privacy Officer Thomas Adhumeau mentions, we will likely continue to talk about it for the foreseeable future:

"This legal saga will likely continue to be at the center stage of the digital industry for years to come."

Introducing the concept of consent lineage

Our VP of Strategy, Frank Ducret , recently took over the Privacy Soapbox (our blog section where we give the stage to guest writers) to discuss the importance of the traceability of consent and introduce the concept of consent lineage:

"Consent lineage can be seen as a history of collected consents, their purposes or usages, and the vendors or participants authorized for these shares. Consent lineage ensures that each consent data point is based on verifiable and shareable proof for various actors in the value chain."

Benchmark of the month: Consent collection in Spain ????

Following the interest surrounding our 2024 European data privacy benchmark released earlier this year, and in light of the recent developments surrounding the topic in Spain, we released a benchmark on consent collection in Spain in 2024 last week, covering a number of topics for organizations operating in the country:

?? Consent banner performance by industry, device, and environment

?? Top-performing consent banner formats

?? Impact of the latest AEPD guidelines on consent rate

Our Country Manager Iberia/LATAM, Sergio G. , comments on that last point specifically, expressing the effect the new guidelines from the Spanish DPA have had on the industry over the last few months:

"Our team at Didomi has seen the profound change driven by the latest guidelines from the AEPD on the Spanish market firsthand. Regulatory changes have the potential to have an impact almost overnight on organizations' and publishers’ business models”
