A solution to the EOT problem.

Currently Main Contractors compete mainly on price.

The biggest risk that all parties face is delayed completion.

Let us change that.

Why not have the Contractors compete first on their ability to deliver on time with price as a secondary option.

It will take a year or 2 to establish but I see it working like this.

Every construction Contract that registers for the scheme has to set down an agreed viable completion date.

At the end of the contract we will know how close the Contractor came to achieving his target.

A league of results will be published every month listing the degree of achievement.

The Top 10% should then be able to negotiate a higher price.

I have thought this through.

Disputes on EOT are usually between Contractor and the employers Contract Administrator.

It is the responsibility of the CA to award reasonable extension of time whenever the employer causes a delay.

In my scheme if the Contractor feels that he has not been treated fairly then he can appeal to the organisation that is preparing the league table of percentages.

Just the threat of an appeal should be sufficient for the CA to change his approach and act reasonably.

The system, when set up, would end the employment of delay analysts and associated lawyers together with a large proportion of adjudications.

However the most experienced of delay analysts would be employed by the organisers of the league table to assess the appeals. The cost of the appeals being funded by the losing party, Contractor or CA

The claims / contract / legal industry should be a service provider to the aec sector only if needed. The vast majority of projects are delivered to everyones satisfaction without their involvement.
