Shaken Baby Syndrome

Shaken Baby Syndrome

Shaken Baby Syndrome (SBS) originated as an untested medical hypothesis but later transformed into a tool for investigating child abuse. The core of this theory suggested that the presence of three specific injuries during an autopsy automatically meant shaking was the cause of a child's death. However, what remained unknown at the time was the existence of other potential causes for those injuries. Unfortunately, this hypothesis gained considerable traction within law enforcement and the medical profession before ultimately being discredited.

Throughout the 1980s and 1990s, SBS cases presented prosecutors with seemingly foolproof evidence, often resulting in convictions across the nation. The exact number of innocent parents imprisoned due to SBS remains uncertain; however, innocence projects nationwide are diligently working to free as many wrongfully convicted individuals as possible. To delve deeper into the topic of Shaken Baby Syndrome and explore other instances of "Junk Sciences," tune in to 'For The Innocent,' available on various podcast platforms including Apple Podcasts, Spotify, Amazon Music, and more.

I had an 18b case in Queens, NYC 15 years ago. I happen to be childhood friend with the daughter of one of the country's most famous forensic pathologists. I had him review the CTs within a week of the mother's arrest. He was appalled and instantly said he would help. Also did some digging and found out the doctor who "diagnosed" the baby seemed to make a habit of calling the police on black mothers. Needless to say, the second I told the DA that the famous pathologist would be getting involved they dismissed the charges. What happened to all the other mothers who weren't so lucky????

I once had a case in Canada where three lawyers advised my client to plead guilty, but with the help of the right experts, we were able to win the case. It's surprising how quickly medical professionals can make judgments and stick to them, even when their conclusions are wrong. In court, it's important to understand probabilities, and I highly recommend the book 'The Drunkard's Walk' to deal with such issues. If you're interested, our national news show covered my case.https://www.dhirubhai.net/posts/phillipmillar_w5-innocent-families-under-suspicion-activity-6897884636077522944-pKzH/?trk=public_profile_like_view
