Is Setting a New Precedent Something to Really Fear?

How many times have we heard; we shouldn't do it because it will set a new precedent? As we all know precedent is based on past decisions that have established a rule that is used to guide our future decisions.???So, while no doubt following current precedent can be useful, it may also have a downside when used as a justification for avoiding difficult situations and decisions.?Hiding behind the fear of "setting a new precedent" may lead to making illogical or outdated decisions. It also makes it very difficult and contradictory in addressing unique or changing circumstances in such initiatives such as DE&I.

?Rather than the fear of setting a new precedent, why not exercise judgement and make reasonable arguments based on the facts of the circumstance? Of course, it goes without saying that relevant legal factors must always be in the foreground. While following a current precedent no doubt makes our decisions much easier and ensures consistency, it may however also get in the way of critical thinking.?Whenever possible, try to consider each situation on its own merits and make decisions based on the specific circumstance.? Decisions based solely on fear of setting precedent are short sighted and may not even be relevant for the current situation. In fact, they may result in missed opportunities.? "There is no precedent in place that I am aware of that states; making an exception to an existing precedent automatically sets a new precedent!" ”And that’s the Other Side of the Coin.”

Thanks for keeping us thinking, Jack! Instead of asking myself, “Will this set a new precedent?” or “Will we be willing to maintain this precedent?,” I think that I’ll start asking myself, “What experience/outcome do I want for this individual/our employees?” … I think a true/renewed focus on employee experience, from start to finish, will undoubtedly challenge any old ways of thinking.
