Selling business-use cars: a litigation tsunami heading your way? Automotive Seminar Thursday 8th February 2018
The recent ASA decision in Glyn Hopkin Ltd v Fiat Chrysler Automobiles UK Ltd has highlighted a potentially catastrophic legal issue for the motor trade. Regulators are now demanding that those traders selling cars to consumers must inform them about any previous business use, even if the car has been mechanically tested and guaranteed. The ASA, trading standards and other regulators are hovering. In the background solicitors specialising in group litigation are preparing to launch class actions worth millions. Media coverage of this issue seems to be fomenting into a campaign that many in our industry would regard as misconceived and unfair.
Until recently many have seen this as a dealer only issue but if retailers are forced to adopt a 2-tier selling price strategy for ex-business use over ex-privately owned vehicles then they will have to start buying using that same approach.
This urgent seminar will address the main issues from the perspective of retail car and LCV dealers, daily rental companies, OEMs, funders of rental/ex rental and trade bodies:
