My new article on the Trademark Modernization Act was published in The Legal Intelligencer. In it, I discuss my experience drafting and submitting petitions for expungement under the new law.

While some might think filing an expungement or reexamination petition may simply require stating that a registered trademark is not in use, the reality is quite different. The bar is set quite high, and practitioners should be prepared to put a lot of work into their petitions.
