Beneath the surface of society's most recent technological advancements is a dark truth that has suffered very little light of consciousness, that is, the impact data and its increasing utility and value play in the distribution of income, wealth, and market power. Large corporations and tech giants wield substantial control over vast troves of data, while individuals, small businesses, and consumers often lack ownership rights over the data they generate. This glaring power asymmetry is nothing but bound to perpetuate and expand economic disparities and restrict opportunities for social and economic advancement. Why?
The root of this issue lies in the structure of data ownership and the mechanisms through which it is controlled. As data becomes an increasingly valuable asset in the digital economy, those who control it wield immense influence over markets, consumer behavior, and even political landscapes. Yet, the framework for determining ownership rights over data remains murky and ill-defined.
The Complexity of Data Ownership
Historically, the concept of ownership has been straightforward: individuals or entities have rights to tangible assets they possess or create. However, the intangible nature of data complicates this notion. Data is often generated through collective efforts, contributed to by various stakeholders including individuals, businesses, and communities. Yet, the prevailing legal frameworks tend to favor those who collect and aggregate data rather than those who contribute to its creation.
It is also true that extraction of a user’s personal data often occurs without the explicit consent or awareness of individuals, exacerbating the power imbalance between data subjects and data controllers. Personal information is harvested through online activities, sensor data, and interactions with digital devices, often without adequate transparency or control mechanisms for the individuals generating this data. This lack of agency over one's own data not only violates privacy rights but also perpetuates economic inequality by concentrating wealth and power in the hands of a select few.

The Social Justice Imperative
In essence, the problem of data ownership inequality is not just a matter of economic imbalance, but also a fundamental issue of social justice. Without equitable access to and control over data, individuals and communities are denied the opportunity to participate fully in the digital economy and shape its trajectory. As we navigate an increasingly data-driven world, addressing this disparity is essential for building a fair and inclusive society.
