You’re considering taking steps to recover money and put an end to the relentless back-and-forth debates with your unfair main contractor. So you need to know the next part of the process is going to give you the greatest chance of recovering the cash that’s rightfully yours – with as little stress as possible.
It’s been another month of successfully resolved disputes on behalf of our subcontractor clients here at RJH Commercial Consulting. Reporting on our latest wins for our subcontractor Clients, like you, shows you we practice what we preach. Yet it also gives you chance to see what the outcome can be like for you, too, when you put your case in our expert hands.
Case study success story
When our client, a groundworks and landscaping subcontractor, came to us about contra-charges, and non-payment of variations and loss and expense, it was an all-too-familiar story. The other party – a well known national main contractor – was withholding money the subcontractor had rightfully earned, thinking they could wield power to do as they pleased as a big nationwide name. Once again, we proved them wrong.
We advised our client that Adjudication was the right process to regain the significant amount of money they were owed, and make sure the main contractor was legally bound to repay it. To do that, we guided the subcontractor through every key stage, taking their stress away and handling the process on their behalf with constant communication and using our multiple years of adjudication expertise.
The adjudication process took place over three separate Referrals, and the result was a huge 3-0 win for our subcontractor client:
·?????? All main contractor contra-charges reversed (from a £106K charge to £0)
·?????? A loss and expense payment of £110K

·?????? Full payment of every disputed variation (£52K in total)
·?????? The main contractor to pay interest to our client on all amounts above
·?????? Our client securing a full extension of time up until the completion date
·?????? And, last but not least, the main contractor had to pay all of the Adjudicator’s fees across all three adjudications.
It’s not always easy to visualise what a ‘win’ looks like, especially when you already feel like you’re losing out with main contractor mistreatment. Yet with huge successes, money rightfully returned and no adjudicator fees for our subcontractor client to pay, the investment in RJH was only a small percentage of the sums recovered.
Real-life examples of what we can – and do – achieve for our subcontractor clients lets you know what you stand to gain in our safe hands. Yet every case is different, so we offer an initial free discussion, with no obligation, for you to tell us about your situation – and for us to advise you how we can help.
