Regulatory Newsletter – October 2022
How to achieve regulatory compliance and maintain access to your key markets in 2023
We expect to see many changes to the world of regulatory affairs in 2023.?Join our regulatory experts for this free webinar focusing on how the chemicals industry can not only maintain ongoing compliance in 2023 but have continued access to their key markets. Our experts will focus on the changes that will have the most impact on industry, including:
Public consultation on new CLP hazard classes could result in updates to SDS, REACH dossiers and poison centre notifications
CSS has a commitment to introduce new hazard classes into the CLP to protect humans from the most harmful chemicals and to help achieve the target of zero chemical pollution in the environment.
A public consultation has just taken place regarding the addition of new classifications for endocrine disrupting properties, persistent, bioaccumulative and toxic (PBT/vPvB) and persistent, mobile and toxic (PMT/vPvM) properties. Where these new classifications apply there will also be a need to update your SDS, labels, REACH dossiers and poison centre notifications.
NCEC’s?horizon scanning tool?can help to relieve the burden of this changing situation. It performs a substance inventory check and identifies whether your substances appear on any global regulatory lists. It provides the results in a clear, easy-to-read report, where you can quickly determine the most recent status of your substances.
The tool determines what your obligations are and what substances need alteration before further use, allowing you to make strategic decisions sooner. This also means you are less likely to miss any important actions that result in non-compliance, protecting not only your reputation, but also helping you to future-proof your product portfolio.?

All EU SDSs must be updated to REACH Annex II requirements by 31 December – including a mandatory telephone emergency response number
Annex II of the?Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) Regulation (EC) No 1907/2006 came into effect on 1 January 2021, outlining the mandatory format for a safety data sheet (SDS) and general indicators of the information contained. A grace period until 31 December 2022 has been given to update any EU SDS compiled according to the old Annex II requirements.
Non-compliance with local adoption of GHS and in the EU with REACH Annex II can lead to business and reputational risks.?Part of this compliance is the mandatory inclusion of a telephone emergency response number in section 1.4 of your SDS.
