Just over 10 days left to update your EU SDSs to avoid losing market access

Annex II of the REACH Regulation (EC) No 1907/2006 came into effect on 1 January 2021.?However, as noted in our recent webinar, 25% of businesses still need to update their EU SDSs.?You have until?31 December 2022?to update your EU SDSs to the new REACH Annex II requirements. Are there any costs of non-compliance?

NCEC has recently been informed that a Belgian port will not be unloading products which are non-compliant with REACH Annex II after 31 December 2022. The port has been clear that there will be no flexibility, and that they will be rigidly observing the deadline for compliance.

This is likely to cause significant supply chain issues to businesses who have not completed their SDS updates.

Please note that Section 9 of REACH Annex II has been updated to align it with the Globally Harmonised System of Classification and Labelling of Chemicals (GHS). Part of this compliance is the mandatory inclusion of a telephone emergency response number in section 1.4 of your SDSs. Defra announces new UK REACH registration submission deadlines

In response to concerns raised by stakeholders around the cost of acquiring the data to complete their UK REACH registrations, and the impact on GB businesses, the UK government has announced that it intends to introduce legislation to extend the registration submission deadlines, across all tonnage bands, by three years through the UK REACH Regulation (subject to the consent of the Scottish and Welsh governments).??

The transitional deadlines for UK REACH apply to organisations who were registrants, downstream users, or distributors under EU REACH before UK REACH was introduced.?Find out here the confirmed deadlines for UK REACH registration submissions.
