Recruiter Rules and Guidelines - Total Recruitment Association Services Africa (TRASA)
1. Candidate Sourcing and Personal Information Protection:
a. Informed Consent: Recruiters must obtain informed consent from candidates before sharing their personal information with potential employers. This consent should include details about the job opportunity and how their data will be used.
b. Data Privacy Compliance: Recruiters must comply with all relevant data protection laws and regulations in Africa when handling candidate information. This includes but is not limited to GDPR (General Data Protection Regulation) compliance where applicable.
2. First Presentation and Entitlement to Invoice:
a. Exclusive Placement Window: If a recruiter introduces a candidate to a company and that candidate is subsequently hired by the company within a two-year period, the introducing recruiter is entitled to invoice for the placement.
b. Documentation: Recruiters should maintain records of all candidate introductions, including dates, communications, and candidate information, to substantiate their entitlement to invoice.
3. Late Discovery of Placement:

a. Two-Year Investigation Period: In the event that a recruiter discovers that their candidate was hired by a company after an extended period of time (beyond the initial introduction), they still have two years to investigate and invoice the full placement fee.
b. Good Faith Requirement: Recruiters are expected to act in good faith when investigating placements and should promptly notify the company of their entitlement to invoice.
4. Ethical Recruitment and Legal Compliance:
a. Non-Discrimination: Recruiters must adhere to strict non-discrimination principles and ensure that all candidates are treated fairly and without bias based on race, gender, age, disability, or any other protected characteristic.
b. Transparency: Recruiters should provide candidates and clients with accurate and complete information about job opportunities, including job descriptions, salary ranges, and company cultures.
c. Confidentiality: Recruiters must maintain the confidentiality of both client and candidate information, only sharing relevant details with consent or when required by law.
d. Legal Compliance: Recruiters must stay up-to-date with labor laws and regulations in the countries they operate in and ensure that all recruitment practices are in compliance with these laws.
