Recourse in CMBS Loans
As a rule of thumb,you can consider CMBS or Conduit Loans to be Non-Recourse. But as with all things, there are a few exceptions like the typical contemporarily described archetypes of bad boys in the field of borrowings and loans.
In layman’s terms, this just denotes that borrowers themselves are by themselves the ones who are responsible for loan repayment.Instead, the property provided as collateral and the cash flows generated by it, serve the purpose of loan repayment if the borrower defaults or in the event of a foreclosure.
Thee door for recourse, however, remains open in case the borrower indulges in any activity that might cause harm to the property. However, the conditions decide the recourse and such situations are rare. Such conditions encapsulate activities like loan fraud, subordinate financing or transfer of property without the formal consent of the lending agent. Other such situations include filing for bankruptcy due to collusive or voluntary activity or not being able to maintain SPE status.
