On a recent marriage-based case
We’re working right now on an urgent marriage-based case.
He lost his job recently and now the question is whether they need a joint sponsor because his spouse is not making above that minimum level of income and our client is currently unemployed.
He will most likely be employed soon so we’re recommending that he file right now without a co-sponsor.
We’re going to file the case anyways and see if USCIS accepts the income both spouses have already made even though our client is currently unemployed.
They have already made enough money combined through the first quarter of the year to exceed the threshold requirement. The only uncertainty is when he will get a new job for ongoing income (and he’s highly qualified, so this isn’t really a negative factor in the case).
