Real Estate Nightmares Avoided: Part 147 ??????

Have you ever bought a "flipped" house or thought about the unique risks they present to home buyers?

Empey Realty recently helped this adorable family purchase a completely remodeled home in Clairemont from a "flipper" who had purchased the home at foreclosure. Not only did the flipper own the home, but also the real estate brokerage, the escrow company, the home warranty company--basically every service provider involved in the transaction except those hired directly by the buyer (us and the home inspectors).

The remodel was quality. But when we got the title insurance policy, there was a huge problem.

They were trying to avoid coverage for any claim made by the previous owner that he was wrongfully foreclosed. This is the MOST LIKELY claim to be brought against the title of this house.

I demanded that the title company remove the bogus exclusions to coverage, and they did.

The thing is, very few real estate agents review or understand title insurance policies. As you pointed out there are a lot of exceptions to title that if properly questioned can be removed. However; as you pointed out a lot of people may not truly understand their rights and therefore get stuck with irrelevant matters that should be deleted prior to closing. Great job!!
