Title history of the Yellowstone Dutton Ranch

?Have you ever wondered about the?Title History?to the Yellowstone Dutton Ranch??The hit TV series Yellowstone has spawned two prequels (1883 and 1923), both of which lend more history to the fictional Dutton family and what might be going on with the title to the ranch.?Spoilers ahead!?

?We know where the story ends in the series finale of Yellowstone. Kayce and Beth Dutton sell the land that is the Yellowstone Dutton Ranch to Thomas Rainwater for $1.25 per acre.?In the series, the Broken Rock Reservation declares the valley as protected and removes the iconic home and buildings.?The actual home used for the show is a located on a 2,500-acre ranch in Montana called the Ford Hollister Ranch (see photo), later renamed the Chief Joseph Ranch in the 1950s

?Starting with the 1883 prequel, James Dutton (played by Tim McGraw) and Margaret Dutton (played by Faith Hill) are moving their family west along the Oregon trail.?They decide to settle in Montana after the death of their only daughter Elsa.?We presume that James Dutton uses his Civil War service to entitle him to a land grant for the land that becomes the Yellowstone Dutton Ranch.?In the show, the valley they lay claim to (called Paradise Valley) is estimated to be over 750,000 acres, which is comparable today to the King Ranch? in Texas. If the Civil War service grant is correct, we can say title vests in James Dutton in 1883.?

?Between 1883 and 1923 (the second prequel), many things occur.?Both James and Margaret Dutton die, leaving two surviving sons:?John Dutton, Sr. (played by James Badge Dale) and Spencer Dutton (played by Brandon Sklenar).?Jacob Dutton (played by Harrison Ford) and Clara Dutton (played by Helen Mirren) take over the ranch after James and Margaret pass.?Jacob is James’ brother, and uncle to John, Sr. and Spencer.??As the first season of 1923 progresses, John Dutton, Sr. and his wife Emma Dutton (played by Marley Shelton) both die.?They have one surviving son, Jack Dutton (played by Darren Mann).?It does not appear that Jacob and Clara Dutton have legal title to the ranch at any point.

?Based on the series so far, we can determine that in 1923, the lineal decedents of James Dutton are Spencer Dutton, a half interest (only surviving son), and Jack Dutton, son of deceased heir John Dutton, Sr., a half interest.?One of these two men is the father to John Dutton, Jr. (played in Yellowstone by Dabney Coleman).?From several hints given in both Yellowstone and in 1923, we know that John Dutton, Jr. became the sole owner of the land and inherited the same from either Jack Dutton or from Spencer Dutton, although the show does not detail for sure which one.?Presumably, the other half interest dies out, and no lineal decedents are left, causing the title to trace back to this point in history, and merging the two lines into one.?

?From several episodes of Yellowstone, we know that John Dutton, Jr. is the father to John Dutton, III (played by Kevin Costner).?John Dutton, III has four children:?Lee, Beth, Kayce and Jamie.?The series finale of Yellowstone identifies that there is an inheritance tax due after the death of John Dutton, III.?Kayce and Beth find a loophole in tax law and decide to sell the ranch to the Broken Rock Tribe to avoid the tax and have the land preserved.?Kayce (played by Luke Grimes) says in the finale: “When my ancestors came here, the land sold for $1.25 an acre.” Apparently, the tax loophole is that they can avoid the tax only if they sell it at that same price paid in 1883 when James Dutton founded the ranch.?

?We can sum up the title history like this:

  • James and Margaret Dutton homestead in 1883
  • They have two surviving sons:?John Dutton, Sr. and Spencer Dutton
  • One of their lines dies out – leaving title to the other line of succession
  • John Dutton, Jr. is either son of Spencer or Grandson of John Dutton, Sr. (via his son Jack)
  • John Dutton, III inherits from John Dutton, Jr.
  • John Dutton, III has four children, two of them sell the ranch to Thomas Rainwater in 2025.

?So, title passes through five generations, sometimes without deeds or wills.?Was the Yellowstone ranch “heirs property,” that is to say, property that stayed in the name of a deceased person without formal transfer to heirs??The part we do not know is how title was brought forward to John Dutton, Jr. and how the half interest ceases to exist.?But I am sure, a future Yellowstone spinoff will lend more hints to this fictional story.
