Quick Analysis: Fake Impeachment

Really, really, fast: The fake impeachment is coming down. The defense team is destroying all theories from the Managers.

The President requesting a friendly foreign government to open or reopen an investigation is not a crime. It is a duty as per Article 2, Section 3 of the Constitution. It is what any given DOJ Attaché does any given day around the world. If what  Trump did is illegal, then what all DOJ Attaches do every day is also illegal.  Even is there is any truth in the New York Times (nice desperate Hit job) about John Bolton, still there is no crime. There is no recording and no one else to corroborate Bolton′s testimony. It would be the President′s word against Bolton′s word. But even if there were….still there is no crime. That would be the President′s foreign policy which is not a crime.  The fact is that investigate corruption is not a crime regardless of the ultimate intend. In the US we base law in facts and acts, not hidden intends.

What would be illegal? If the President asks Ukraine to create or fabricate fake witnesses or evidence, that would be a crime. And that is NOT the case here.

 Trying to impeach a President because of ¨Abuse of Power¨ is like trying to put someone in jail because he or she is ¨evil¨ . An Abstract open to interpretation term. You need an actual crime: killing someone, spy for the Russians, place a bomb, rob a bank, etc., etc., etc.  Those are actual crimes. Being ¨evil¨ or abuse of power are not.

 The second article, ¨Obstruction of Congress¨ is also fake. There is something called Obstruction of Justice but not of Congress. If Congress wants someone to testify and the President does not,  then the third Brach of the Government, the judiciary decides. As simple as that.

We need a crime, actually a HIGH crime for impeachment. The US is NOT a Parliamentary system like Spain, UK, Italy, etc. There the Parliaments can remove any Prime Minister without a crime: because of a bad decision, bad economics, etc., etc. That is the Censorship or Confidence vote they do there.  But in the US, in a PRESIDENTIAL system, for an Impeachment you need a crime. You need something to put your FINGER at. Completely different issues. Apples and oranges.

About the Whistle blower: While we don’t know for sure, but based on open sources there is a very high probability his name is Eric Ciaramella  (https://www.washingtonexaminer.com/news/gop-senator-names-alleged-whistleblower-eric-ciaramella-needs-to-be-pulled-in-for-testimony ). My guess based on open sources was very right if Eric is really the whistleblower. He is a liberal, left wing,  Democratic Party linked, CIA person who is involved in Ukrainian / Russian analysis and who was in rotation at the NSC. In a week this will be over unless the establishment IYIs (Taleb ′s classic term) like Mitt Romney and company bend to the Democrats.

Great analysis! Thanks for sharing your thoughts. I agree with you completely. Interesting disclosure of whistleblower. I am very troubled by Lt Col Vindman. Poor judgement to go against POTUS to satisfy his political activism objectives. It appears to me that John Bolton was likely the source that prodded him into action. If so, Bolton may have been implementing a "payback" scheme against POTUS and his more moderate inner circle. Clearing he was "odd man out" on some of his more hawkish foreign policy thought about Middle East actors. In any case I am totally amazed that President Trump has the fortitude to endure the relentless attacks by The 3 Amigos (Pelosi, Nadler and Schiff) and still get the important things done for our country. At this stage of my life I can't imagine how he does it!
