Protecting your estate from divorce

Protecting your estate from divorce

101,077 couples divorced in 2015. Some of these cases may have been straight forward however the majority of cases can be complex. For example, children and properties. Also, each individual understandably want to make sure they walk away with what is rightfully theirs, or what they believe is rightfully theirs.

One important factor that gets missed is that during the lengthy divorce proceeding, if either party was to pass away then their share of the estate can pass to the spouse they are divorcing automatically, unless they have made a Will.

A Will may already be in place. However if this was made during a healthy and loving marriage then this Will most likely would've been written to prioritise the spouse, however as the marital situation has changed, the Will must be updated.

We come across people going through marriage break ups and they want to ensure any property they own, money and savings are passed to people of their choice and not their existing spouse in the event of the inevitable happening.

If you are going through a marriage break up or divorce then be sure to get your affairs in order.
