On November 20, 2024, the Verkhovna Rada of Ukraine sanctioned the establishment of a legislative framework designed to meticulously document the impact of the Russian Federation's military incursion on the personal, non-material rights of Ukrainian citizens. The legislation, formally recognized as the Law of Ukraine “On Recording Information on Damage Caused to Personal Non-Property Rights of Individuals as a Result of the Armed Aggression of the Russian Federation against Ukraine” (Registration No. 10256), inaugurates a new phase in addressing the extensive repercussions of the conflict.
Highlights of the Law
The statute underlines the initiation of a systematic approach to aggregate and analyze data concerning individuals adversely affected by the conflict through various means, including death, displacement, injury, and other trauma-induced scenarios. This compilation is not limited to physical or economic aspects but extends to non-tangible rights violations, signifying a comprehensive approach towards addressing the aftermath of aggression.
Key elements encompassed within the law include:
Purpose and Implementation
This legislative measure mandates the creation of a centralized recording system, which is envisaged to facilitate the consolidation of information from diverse public registers and digital platforms. Through this integration, affected individuals are envisioned to gain access to a consolidated database documenting the damages endured, thereby assisting them in seeking restitution and asserting their legal rights.
The system aims at an automated data collection model, relying on state infrastructure and direct inputs from affected parties or their representatives. This initiative underscores the government’s intent to employ technology-driven solutions to enhance the accuracy and efficiency of data management processes.
Extended Objectives
Apart from immediate relief and documentation efforts, the law anticipates future engagement with international forums for compensation claims and judicial advocacy. It propels the framework for devising supportive measures for victims, thereby laying the groundwork for a robust compensation mechanism.
Additionally, a unique focus is placed on children impacted by the conflict. The legislation mandates the formation of a designated register for children subjected to deportation or forcible displacement, addressing a critical concern of child welfare amidst warfare. The Ministry of Justice of Ukraine is assigned as the custodian of this paramount register.
