While effective in targeting overtly prohibited content like hate speech and graphic violence, these systems grappled with discerning nuanced context. Notably, AI algorithms struggled to distinguish between genuine expressions of extremism and content satirizing extremist ideologies, exposing the limitations of automated moderation and the imperative for human intervention.
The staggering volume of spam, pornography, hate speech, and violent content overwhelmed platforms' in-house moderation teams, compelling them to seek external solutions. Thus, outsourcing emerged as a pragmatic approach to meet the escalating demands of the time. Social media platforms began contracting additional outside labor, tasking content moderators with making split-second decisions on the appropriateness of User-Generated Content. However, this reliance on outsourced teams blurred lines of accountability and responsibility for content moderation practices.
Section 230 further complicated this landscape by absolving platforms of liability for User-Generated Content, incentivizing outsourcing and allowing platforms to manage their burgeoning content volumes without bearing direct responsibility for moderation processes. Content Restrictions & Conflict Reporting:
Social content platforms have emerged as powerful tools for truth-telling and accountability amid the ongoing Gaza-Israel conflict. In response to censorship and selective reporting, citizen journalists and grassroots activists have turned to these platforms to share firsthand accounts, amplify marginalized voices, and expose the harsh realities of life in conflict zones.
The recognition of individuals like Palestinian journalist Motaz Azaiza goes on to show the pivotal role played by social media in shaping global perceptions of conflict. Azaiza's documentation of the Israeli military offensive in Gaza earned him a place among Time magazine's '100 Most Influential People' of 2024. Forced onto the frontlines by the horrors of the conflict, Azaiza provided raw and unfiltered footage that captured the human toll of the violence, offering a poignant chronicle of Gaza's transformation.
Plestia Alaqad, another 22-year-old aspiring journalist from Gaza, rose to prominence after October 7, when she began documenting the effects of Israeli bombardment on her home city. Taking it upon herself to report on the war, her social media feeds quickly became a powerful record of the devastation in Palestinian territory. On October 9, a video showing her calm composure as bombs fell nearby went viral, causing her Instagram following to skyrocket from about 3,700 to over 4.6 million. Despite the risks, Plestia's reporting highlighted the realities of life in a conflict zone, eventually prompting her to flee to Australia with her family for their safety.

New Legal and Regulatory Frameworks:
The Digital Services Act (DSA) introduced in Nov 22, and applied in full across all EU Member States from 17 February 2024 represents Europe's latest effort to enhance transparency and accountability among powerful tech platforms, addressing the societal risks they present. Paired with its counterpart legislation, the Digital Markets Act, it creates a unified regulatory framework applicable throughout the EU, potentially setting a global benchmark in platform governance.
DSA oversees a spectrum of online intermediaries and platforms, including marketplaces, social networks, content-sharing platforms, app stores, and online travel and accommodation platforms. It's designed with a dual purpose: to combat illegal and harmful activities online, including the dissemination of disinformation, while ensuring user safety, upholding fundamental rights, and cultivating a level playing field in the digital landscape.
Just recently, a second probe into Facebook and Instagram, owned by Meta, has been opened by the EU, investigating whether these platforms cause addictive behavior in children. This falls under the same Digital Services Act (DSA). This new investigation follows an earlier one, focusing on Meta's efforts to counter disinformation. The DSA targets 23 major platforms, including Snapchat, TikTok, and YouTube, demanding compliance or risking fines up to 6% of global turnover, or even bans for severe and repeated violations.
Other platforms under DSA scrutiny include TikTok, which faces an investigation over its impact on young people, and its Lite app's reward schemes were suspended for potentially harming mental health. Additionally, Chinese retailer AliExpress and social media platform X, formerly Twitter, are also being investigated. The DSA's broad scope also requires digital marketplaces like AliExpress and Amazon to tackle the sale of fake and illegal goods.
Social Media Regulations in Pakistan
Pakistan blocked access to social media platform X around the time of elections in February 2024.
Punjab Assembly, on Monday, May 20th passed the Defamation Bill, 2024, dismissing all amendments proposed by the opposition amidst ongoing protests.
The bill extends to electronic, print, and social media platforms, including Facebook, TikTok, Twitter, YouTube, and Instagram, imposing a fine of PKR 3mn for disseminating false information or engaging in character assassination.
Special tribunals will be established to handle cases under this bill, with a mandate to resolve them within 180 days.
In response to the bill, journalists and media personnel boycotted the assembly session and held protest demonstrations outside Punjab Assembly.
The president of the Lahore Press Club has denounced the Defamation Bill 2024, calling it ‘non-democratic’ and criticizing the Punjab government for its introduction.
While digital rights and media activists criticize the bill as another attempt by the government to stifle online dissent and limit freedom of expression, the current administration argues that it is a necessary measure to ensure digital safety and regulate online content effectively.

In 2023 alone, platforms like Facebook and YouTube removed millions of pieces of content related to violence, sexism, racism, and self-harm. As demonstrated by the Digital Services Act, which imposes strict compliance requirements on major platforms in the EU, there are pathways to achieving this balance. By promoting responsible algorithm use and enforcing clear guidelines, we can create a digital ecosystem that is both safe and inclusive.
