Proposal For A National 2A Firearms Verification Card

 This Is Submitted For Respectful Public Discussion and Consideration. This is a draft proposal for a bill to be recommended to my congressmen. I feel that in order to address the increase in firearms violence, we must as responsible gun owners take measures to ensure that firearms stay in the hands of responsible gun owners and out of the hands of criminals.

In addition to this, I will be drafting a proposal for the regulation, more accurately the enforcement of existing regulation of violence and adult content in media such as video games, television and movies.

By addressing both the cause of violence in teens and adults as well as the tools that they use to act out that violence we can find a lasting solution.

Given the highly polarized nature of todays society, we must realize that solutions are only found through compromise and that we must respectfully listen to the views and reasons from both side.

2A Card Proposed Bill

                                                                           Purpose Summary

The second amendment is key to maintaining a free and democratic society. Should the citizens of a nation no longer have the means to resist the power of the government, they will quickly lose their freedom to tyrants. Over the past century, the lethality of firearms has increased exponentially and placed an awesome burden of responsibility on legally armed citizens. This responsibility included the regulation of sales and trade in modern firearms. It is imperative that the sale and trade of firearms exclude those who have been convicted of violent crimes and those with significant mental illnesses. 

In short, it is important that as responsible gun owners, we keep firearms in the hands of responsible gun owners and out of the hands of criminals. The only effective means to do this is to provide a federally based verification system for firearms businesses.

                                                                      Summary of Proposal

It is proposed that the federal government create a “National 2A Card” and “2A Internet Data Base”. This card would be chip enabled for dealer point of sale background checks and connected to an internet based 2A Eligibility Data Base. The valid 2A Card would be required to be in the possession of the card holder for the purchase, sale, public use and/or transport of a firearm anywhere in the United States.

                                                                       Key Requirements

  1. Application, Background Check and Receipt of the 2A Card must be able to be completed within less than 72 hours for any US Citizen.
  2. Internet Background Checks Must be completed instantly at the point of sale.
  3. Point Of Sale background checks will instantly return a result of “Eligible”, “Non-Eligible” or “Call Police”.
  4. All US Citizens will have the ability to create and manage their own 2A Card Internet Based accounts.

                                                                       Classes of 2A Card

  1. Citizens 2A Card

        a. Available for free to All eligible US Citizens within 72 hours of application.

    2.  Mentors 2A Card

          a. Available to 2A Card Holders who have passed a local firearms safety course

    3. Open Carry 2A Card

         a. Available to 2A Card Holders who have passed a local firearms safety course, carry course and range qualification.

    4. Instructors 2A Card

         a. Available to 2A Card Holders who have passed a local firearms instructor course and range qualification every five years.

    5. Class III 2A Card

         a. Available to and required for 2A Card Holders who own Class III firearms.

         b. Requires annual renewal and verification of proper storage and use.

    6.  Dealers 2A Card

         a. Required for any 2A Card Holder who collectively transfers 20 or more firearms into or out of their registered inventory in a 365 day period.

         b. Dealer 2A Card Holders must utilize a CAC Card reader and log in via internet access during all firearms transfers.

                                                             Penalties/ Grace Period

  1. There would be a two year grace period from the date of enactment before stringent enforcement would go into effect.
  2. During this two year grace period
  3. Department of Public Safety, Firearms Retailers/ Dealers and Firearms Related Businesses (Gun Clubs/ Ranges) will come into compliance with 2A laws.
  4. After the two year grace period has passed Penalties for being out of compliance with 2A Card Laws will be established by each state in accordance with federally established minimum punishments.

                                                              Article I: Eligibility

  1. Citizens 2A Card Eligibility

         a. Available for free to all US Citizens who have the constitutional/ legal right to carry a firearm.

         b. Required as proof of identification and eligibility in order to buy or sell fire arms and/or ammunition or to patronize a business which caters to the use of firearms (i.e. Shooting Ranges).

         c. Card Holder must be 18 years of age or older

         d. Must be renewed every five years

         e. Must not be legally prohibited from owning a fire arm in the United States

                                                           Article II: Applicability

  1. Applicable to any firearm that can produce a muzzle energy of 270 ft lb or greater (.380 ACP or larger)
  2. This specifically excludes .22 caliber rifles, .22 caliber hand guns and construction fastener devices.
  3. Required to possess or use an applicable firearm outside the residence of the firearm owner.

                                                         Article III: Enforcement

  1. A valid 2A card must be visually verified by any business owner or private person dealing in firearms or firearms related activities prior to allowing entry or doing business with any person related to the sale or use of firearms and ammunition.
  2. Gun clubs and ranges must visually verify the 2A card prior to allowing entry (similar to a bar or night club)
  3. A 2A card holder may escort up to 3 minors or non-2A Card holders who remain under their physical / visual control.
  4. Escorting more than 3 non-2A Card Holders required an “Mentors 2A Card”.
  5. Department of Public Safety and Police may check up on private businesses to ensure compliance with 2A Card and other applicable laws.
  6. Department of Public Safety and Police may request private citizens to present their 2A Card when they are seen in possession of a firearm outside the home.
  7. Failure to comply with 2A Card laws or safe firearms practices may result in fines or imprisonment depending on the severity of the offence.

                                                              Article IV: 2A Card Format

  1. The 2A Card is similar in size and shape to a drivers license to include the card holders picture and holographic security markings
  2. 2A Card contains a chip that records the serial number/ make/ model/ date of manufacture of each firearm owned by the card holder.
  3. The 2A Card also records on the chip the card holders’ 2A eligibility status; “Eligible”, “Non-Eligible” or “Flagged/ Call Police”.
  4. A “Citizens 2A Card” holder may purchase a CAC Card reader to better manage their 2A Card Personal Account.

                                                  Article V: Application and Receipt Process

  1. 2A Cards may be applied for through either the local Department of Public Safety or Authorized Subcontractors.
  2. Authorized Sub-Contractors are those privately owned gun clubs or firearms retailers who meet specified accountability standards and have access to the 2A Eligibility Data Base.
  3. 2A Card Applications through Authorized Sub-Contractors must be done in person and are completed “while you wait”.
  4. Authorized Sub-Contractors are subject to regular checkups by DPS and Police.
  5. 2A Cards may be applied for via the Department of Public Safety web site.
  6. The Department of Public Safety has three business days to process and complete a 2A Card Application.
  7. Fees may not be charged by either the Department of Public Safety nor an Authorized Sub-Contractor for a “Citizens 2A Card”
  8. Reasonable fees may be assessed for more advanced 2A Cards such as a Mentors 2A Card or and Instructors 2A Card.
  9. Fees May be assessed in order to meet training requirements for more advanced 2A Cards above the “Citizens 2A Card”.
  10. Authorized Sub-Contractors may claim tax write offs for equipment and time related to Citizens 2A Card processing.

                                                   Article VI: Verification of Eligibility

  1. 2A Card Applicants Must Present two forms of photo ID and proof of US Citizenship.
  2. Applicants must submit to an instant criminal and mental health background check on the national criminal data base.
  3. Instant Background check displays only “2A Eligible”, “2A Non-Eligible” or “Call Police”
  4. Instant Background check site is only accessible by licensed firearms dealers and law enforcement.
  5. Law enforcement will have full informational access to the web site but must register each log in.
  6. Law enforcement access allows view of owners’ inventory and buy/sell activity, criminal record and special flags for mental health conditions or warnings.
  7. 2A Card Holders may access and manage their individual accounts on the national data base.
  8. Update inventories, transfer ownerships, renew card, upgrade 2A Levels
  9. All 2A Applicants must be registered with US Selective Service in accordance with current laws.
  10. Males and Females must register with selective service.

                                                        Article VII: Person to Person Firearms sales

  1. Anyone selling a firearm person to person, must verify that the buyer has a current and valid 2A card.
  2. Anyone transferring ownership of more than 20 firearms in a 365 day period must register as a “2A Dealer” or face heavy fines.
  3. After completing the sale of the firearm, the seller must go online and transfer the serial number of that firearm to the new owner within 14 days.
  4. The new owner must in turn accept the firearm into their inventory within 14 days.
  5. If the new owner fails to register the firearm in their inventory within 14 days, local police will receive an automated notice with the buyers’ personal information based on their 2A Card number.
  6. The buyer will then be subject to fines and legal actions
  7. If the buyer was not 2A eligible and purchased the firearm using a fake or expired 2A card, they will be subject to further legal actions.
  8. If a crime is committed with a firearm that has not been properly transferred or reported, the registered owner may be subject to criminal liability for the crime or fines.
  9. Private buyers and sellers may freely elect to verify real time 2A eligibility via the 2A Website or Mobile App prior to completing a person to person firearms transfer.

                                                            Article VIII: Commercial Fire Arms Sales

  1. Anyone who cumulatively buys and/or sells more than 20 firearms in a 365 day period must register as a firearms dealer.
  2. A firearms dealer is subject to a comprehensive criminal background check.
  3. A firearms dealer will have “Eligible/ Non-Eligible/ Call Police” access to the Instant Background check web site.
  4. Any firearms bought or sold by a registered firearms dealer must be instantly registered into and out of inventory at the time of purchase or sale via the 2A Card web site and CAC enabled computer.
  5. Failing to register as a firearms dealer within 30 days after buying/ selling more than 20 firearms within 365 will result in heavy fines and criminal actions.

Honestly I was hoping that this would create at least a little discussion. As much as everyone is screaming about how horrible gun violence is these days we should do something to find a solution.
