O Allah, I take refuge with You from misleading or getting misled; making mistakes or being made to make mistakes; doing wrong or being made to act wrongly; and (from) acting ignorantly or being made to act with ignorance. O Allah Mighty is Your protection, Holy are Your names, Sublime are Your praises, and there is no god besides You. In the name of Allah, sufficient for me is Allah and I depend on. O Allah, and there is no power and strength except with Allah. O Allah, strengthen my heart and let truth appear on my tongue. We implore Allah Almighty to help us serve His cause and render our work for His Sake. I praise Allah, except whom there is none to be worshiped, who is the Ruler of the world. He is innocent and pure free from all blemishes, defects, flaws, or shortcomings. He gives refuge and sustains all.

I have thus discharged again my duty of conveying His message and advice. You should accept it, May peace be on the followers of the guidance.

To all whom these presents shall come, May peace be on the followers of the guidance.

We continue to invite you to accept the obedience, sympathy, and love of Allah Who is One and Who is without an associate. You should follow his prophet’s and messengers (Peace (Salaam) on (all) the Prophets and Messengers) and should believe in the message of Allah which they have brought.

Surah Al-Baqarah 2:50-54

And when We parted the sea for you; then We rescued you, and drowned the Pharaoh's people as you were looking on! And when We appointed forty nights for Musa, then you took to yourselves the calf thereafter, and you were unjust! (Verses 50-51)

Verse 50 refers to certain things which had happened in the days of Sayyidna Musa (Moses) (pbuh). He, in his capacity as a messenger of Allah, continued efforts for a long time to make the Pharaoh and his people see Truth, but when they persisted in their denial, Allah commanded him to take the Israelites along with him and leave Egypt surreptitiously. On their way, they came across a sea while the Pharaoh was behind him with his army in hot pursuit. Allah commanded the sea to split, and make way for Sayyidna Musa (Moses) (pbuh) and his people. So, they went over smoothly. But when the Pharaoh and his army followed them into the sea, it gathered the water back so that the Pharaoh and his men were drowned then and there.

Verse 51 refers to other incidents in the same story. When the Pharaoh had been drowned, the Israelite's, according to one report, went back to Egypt, or, according to another, began to live somewhere else. Having at last found a peaceful existence, they now wished they could receive a Shari'ah, or a religious code of laws, from Allah which they should follow. Allah answered the prayer of Sayyidna Musa (Moses) (pbuh), and promised that if he came to the Mount Tur (Sinai) and devoted himself to worship for a month, he would receive a Divine Book. He gladly obeyed the Commandment, and was granted the Torah. But he was ordered to continue to worship for ten days more, because he had broken his fast after a month and thus lost the special odor which rises from the mouth of a fasting person and which is very pleasant to Allah; so Allah commanded him to fast for ten additional days and regain that odor. Thus, Sayyidna Musa (Moses) (pbuh) completed forty days of total fasting and devotion. While he was on Mt. Sinai, something very odious happened to the Israelite's. Among them there was a man called Samiriyy. He fashioned the figure of a calf out of gold or silver, and put into it some of the dust which he had picked up from under the hooves of the horse of Jibra'il (the Archangel Gabriel ) (pbuh), at the time when the Pharaoh and his army had been drowned by the Archangel. The golden calf immediately acquired life. The ignorant among the Israelite's were so impressed that they started worshiping it.

Verse 51 calls them "unjust" for having committed this sin, for 'injustice' lies in putting things in the improper places, and idolatry is essentially just that.

A doctrinal point

Verse 50 speaks of the splitting of the sea, and clearly proves miracles do occur at the hands of prophets, which some Westernized Muslims have been trying to deny. (Bayan al-Quran)

Then We pardoned you, even after that, so that you be grateful. (Verse 52)

The Israelites were forgiven only when they had offered Taubah (repentance), as recounted in Verse 54. In saying that they were pardoned so that they might learn gratefulness, the present verse employs the Arabic word:

Which indicates expectation. In the present context it does not mean that Allah had or could have any doubt or misgiving about this or any other matter; what the word implies here is just that when a man receives a pardon, the onlookers may expect him to feel grateful.

Then We gave Musa the Book and the Criterion (of right and wrong) so that you find the right path. (Verse 53)

Torah is the book which was given to Sayyidna Musa (Moses) (pbuh). In the language of the Holy Qur'an, al-Furqan is a term signifying something which separates truth from falsehood or distinguishes the one from the other. In the present verse, it refers either to;

(a) the injunctions of the Shariah which are to be found in the Torah, for the Shariah resolves all the differences that may arise with regard to the doctrines or the practice of good deeds; or to

(b) miracles which decide between a true or a false claim in a palpable manner; or even to

(c) the Torah itself which has the twin qualities of being a Book of Allah and of being an instrument for separating truth from falsehood.

And when Musa said to his people: 'My people, you have wronged yourselves by your taking the calf (as God). So, turn in repentance to your Creator and slay yourselves. That will be better for you in the sight of your Creator" Then, He accepted your repentance Indeed He is the Most-Relenting, the Very-Merciful. (Verse 54)

This verse describes the special mode of offering their Taubuh (repentance) which was prescribed for the Israelites in this situation,-- that is to say, those who had not indulged in the worship of the golden calf should execute those who had. Similarly, in the Islamic Shari'ah too, certain major sins necessarily entail capital punishment even when the sinner has offered this Taubah -- for example, life in return for a life in the case of intentional homicide, or death by stoning in the case of adultery established through proper evidence.

Then the Israelite's acted upon this divine commandments, they became worthy of receiving the mercy and favor of Allah in the other world.

The?Qur'an?does not in any place order that adulterers be stoned, rather their prescribed punishment is being whipped 100 times (24:2). Some ulamaa', however, are unanimous in their opinion that the penalty for married men or women who commit adultery is to be stoned to death.

The prescribed punishment for adultery in the halachah is stoning to death (based on Deuteronomy 23:23-24 and extended by the rabbis to include all cases of adultery) and it is likely that Islamic scholars working in the 8th and 9th century in Iraq were influenced by Jewish law to include this more strict punishment, which was not common practiced by the believers of Muhammad's (pbuh) time and the first century of his movement. The prophet the below Hedith preferred to not hear the man admit to it or implement it. (Bukhari :: Book 8 :: Volume 82 :: Hadith 814 see below)

Narrated Abu Huraira:

As far as the punishment of stoning to death is concerned, the Holy Qur’an declares that those who indulge in fornication or adultery, (the same Arabic word zana is used for both), should be flogged one hundred times. Here in this verse there is no mention of stoning at all anywhere.

Malik :: Book 41 : Hadith 41.1.1

Malik related to me from Nafi that Abdullah ibn Umar said, "The Jews came to the Messenger of Allah, may Allah bless him and grant him peace, and mentioned to him that a man and woman from among them had committed adultery. The Messenger of Allah, may Allah bless him and grant him peace, asked them, 'What do you find in the Torah about stoning?' They said, 'We make their wrong action known and flog them.' Abdullah ibn Salam said, 'You have lied! It has stoning for it, so bring the Torah.' They spread it out and one of them placed his hand over the ayat of stoning. Then he read what was before it and what was after it. Abdullah ibn Salam told him to lift his hand. He lifted his hand and there was the ayat of stoning. They said, 'He has spoken the truth, Muhammad. The ayat of stoning is in it.' So the Messenger of Allah, may Allah bless him and grant him peace, gave the order and they were stoned . "

Abdullah ibn Umar added, "I saw the man leaning over the woman to protect her from the stones."

Malik commented, "By leaning he meant throwing himself over her so that the stones fell on him."?

Dawud :: Book 38 : Hadith 4435

Narrated AbuHurayrah:

(This is Ma'mar's version which is more accurate.) A man and a woman of the Jews committed fornication.

Some of them said to the others: Let us go to this Prophet, for he has been sent with an easy law. If he gives a judgment lighter than stoning, we shall accept it, and argue about it with Allah, saying: It is a judgment of one of your prophets. So they came to the Prophet (peace_be_upon_him) who was sitting in the mosque among his companions.

They said: AbulQasim, what do you think about a man and a woman who committed fornication? He did not speak to them a word till he went to their school.

He stood at the gate and said: I adjure you by Allah Who revealed the Torah to Moses, what (punishment) do you find in the Torah for a person who commits fornication, if he is married?

They said: He shall be blackened with charcoal, taken round a donkey among the people, and flogged. A young man among them kept silent.

When the Prophet (peace_be_upon_him) emphatically adjured him, he said: By Allah, since you have adjured us (we inform you that) we find stoning in the Torah (is the punishment for fornication).

The Prophet (peace_be_upon_him) said: So when did you lessen the severity of Allah's command? He said:

A relative of one of our kings had committed fornication, but his stoning was suspended. Then a man of a family of common people committed fornication. He was to have been stoned, but his people intervened and said: Our man shall not be stoned until you bring your man and stone him. So they made a compromise on this punishment between them.

The Prophet (peace_be_upon_him) said: So I decide in accordance with what the Torah says. He then commanded regarding them and they were stoned to death.

Az-Zuhri said: We have been informed that this verse was revealed about them: "It was We Who revealed the Law (to Moses): therein was guidance and light. By its standard have been judged the Jews, by the Prophet who bowed (as in Islam) to Allah's will.?


Bukhari :: Book 8 :: Volume 82 :: Hadith 814

Narrated Abu Huraira:

A man from among the people, came to Allah's Apostle while Allah's Apostle was sitting in the mosque, and addressed him, saying, "O Allah's Apostle! I have committed an illegal sexual intercourse." The Prophet turned his face away from him. The man came to that side to which the Prophet had turned his face, and said, "O Allah's Apostle! I have committed an illegal intercourse." The Prophet turned his face to the other side, and the man came to that side, and when he confessed four times, the Prophet called him and said, "Are you mad?" He said, "No, O Allah's Apostle!" The Prophet said, "Are you married?" He said, "Yes, O Allah's Apostle." The Prophet said (to the people), "Take him away and stone him to death." Ibn Shihab added, "I was told by one who heard Jabir, that Jabir said, 'I was among those who stoned the man, and we stoned him at the Musalla ('Id praying Place), and when the stones troubled him, he jumped quickly and ran away, but we overtook him at Al-Harra and stoned him to death (there).' "?

Some crimes require only two witnesses while others necessitate four witnesses (adultery, for example). Some crimes are legally proven only by oathtaking, such as in 'Qasamat' where 50 solemn oaths are taken by claimants to prove a punishable crime.

In an adultery trial by the Islamic authorized courts 4 people of known good character must eye witness the act of adultery before any ruling can be made.

Adultery in Islam is one of the most heinous and deadliest of sins. Its enormity can be gauged from the fact that it has often been conjoined in the Qur’an with the gravest of all sins: shirk or associating partners with Allah. the enormity of this sin is no small measure due to its dire consequences affecting individuals, families, and societies.

Among these are that it entails infidelity and erodes the trust and tranquility that are the foundations of a fulfilling family life; it dissipates one’s energies; it undermines peace at home; it corrodes the purity of one’s soul and hence destroys one’s faith; finally, it exposes the person to the wrath of Allah, thus resulting in eternal damnation.

It is no wonder then that Allah and His Messenger have sounded dire warnings against adultery in so many ways.

To list only a few instances: Allah says in the Qur’an, (And come not near unto adultery. Lo! it is an abomination and an evil way) (Al-Isra’ 17: 32).

(And the servants of the Beneficent) are those who do not invoke another god with Allah, and who do not…commit fornication/adultery, for whoever does that shall receive the penalty; for him shall the torment be doubled on the day of resurrection, and therein he shall abide forever, disgraced, save him who repents and believes and does good works; those, Allah shall change their misdeeds into good works. And Allah is Forgiving, Compassionate) (Al-Furqan: 68-70).

The Prophet (peace and blessings be upon him) said, “Whoever guarantees me that he will guard his chastity, I will guarantee him Paradise” (Al-Bukhari). abu Hurayrah reports that the Messenger of Allah said, “No one commits adultery while still remaining a believer, for faith is more precious unto Allah than such an evil act!” In another version, it is stated, “When a person commits adultery he casts away from his neck the bond that ties him to Islam; if, however, he repents, Allah will accept his repentance” (Al-Bukhari, Muslim, Abu Dawud, An-Nisa’i and others).

The Prophet (peace and blessings be upon him) further said: “[Under Islamic laws in an Islamic state] It is not lawful to shed the blood of a Muslim except for one of three sins: a married person committing fornication, and in just retribution for premeditated murder, and [for sin of treason involving] a person renouncing Islam, and thus leaving the community [to join the enemy camp in order to wage war against the faithful].” (Al-Bukhari, Muslim, Abu Dawud, Tirmidhi, and An-Nasa’i)

During his ascension, the Prophet (peace and blessings be upon him) was escorted by Jibreel and shown different types of punishments meted out to those guilty of various major offenses. While recounting the various scenes shown to him, he said, “Then Jibreel took me and we passed by a group of people with terribly inflated bodies emitting worst foul smells just like that of open sewers; when I enquired who they were, he replied, ‘These are those who commit adultery!’” (Ibn Khuzaymah) the Prophet (peace and blessings be upon him) said: “Faith is like a shirt that Allah places on those He chooses; but whoever commits adultery his shirt will be taken off from him; if he were to repent sincerely, Allah will place it back on him.” (Al-Bayhaqi)

“There are three types of sinners that Allah will not speak to on the Day of Resurrection; neither He will purify them nor will He even look at them; rather they will suffer severe punishment: an older person who commits adultery, a king or ruler who lies to his subjects, and a poor person who acts arrogantly!” (Muslim and An-Nasa’i)

“When adultery becomes rampant in a nation Allah will expose them to His chastisement.” (Abu Ya`la)

“When promiscuous behavior becomes rampant in a nation, Allah will send upon them such (strange) diseases that their own ancestors never heard of.” (At-Tabarani)

“There are seven categories of people who will be granted protection under the shade of Allah on the Day when there is no other shade;… among them is a young person who is seduced by a woman of great beauty and wealth and yet he rejected her advances saying ‘I fear Al lah!’” (Al-Bukhari and Muslim)

The Prophet (peace and blessings be upon him) said, “O mankind! Beware of fornication/adultery for it entails six dire consequences: three of them relating to this world and three to the next world. As for the three that are related to this world, they are the following: it removes the glow of one’s face, brings poverty, and reduces the life-span. As for its dire consequences in the next world they are: it brings down the wrath of Allah upon the person, subjects him to terrible reckoning, and finally casts him in hell-fire” (Al-Bayhaqi).

Given the above, it is to be noted that the punishment specified for an unmarried person guilty of fornication in the Shari`ah is 100. In the very beginning of Surat An-Nur, it is stated that: (The woman and the man guilty of adultery or fornication,- flog each of them with a hundred stripes: Let not compassion move you in their case, in a matter prescribed by Allah, if ye believe in Allah and the Last Day: and let a party of the Believers witness their punishment) (An-Nur 24: 2).

Adultery destroys family lives and values; it destroys societies causes children to be parentless or raised in a family without both spouses. Creates high divorce rates and lowers the morals and standards of marriage and commitment in a marriage.

Important Note: It is not permissible to take the law into your own hands. Such matters questions one should ask their Islamic scholars or governments for information or guidance. Non-Islamic governments have various rules or laws in such matters and if you're a citizen of such it's not up to individual's, laymen, students etc. to take actions in their own hands doing so can be a violation of laws and the Islamic doctrine or jurisprudence ruling's etc.
