PROMOTING UNITY AND EQUALITY: THE IMPERATIVE NEED FOR A UNIFORM CIVIL CODE IN INDIA

In the diverse landscape of India, many cultures, religions, and traditions coexist, each with its own set of norms and laws. Though a symbol of India's richness, this diversity also presents a maze of personal laws applied to different religious groups. The proposal of a Uniform Civil Code (UCC) has been suggested as a way to harmonise these separate laws. However, the dialogue surrounding the UCC requires a thoughtful, respectful, and thorough discussion, acknowledging India's varied cultures while addressing issues arising from the misuse of personal laws.

Fostering Greater National Unity

I believe the UCC is a key element for enhancing national unity. The current system, where various personal laws based on religious or tribal affiliations exist, may unintentionally create divisions within society. A UCC could reduce these divisions, creating a powerful symbol of 'Unity in Diversity.' It reinforces the idea that no matter our religious or ethnic identities, all citizens are equal parts of the nation and subject to the same laws. This unified approach could discourage the misuse of personal laws and maintain societal harmony.

Advancing Gender Justice and Equality

The journey towards gender justice and equality in India has seen many ups and downs. Some personal laws, especially those related to marriage, divorce, inheritance, and guardianship, often reflect outdated, gender-biassed norms. The implementation of a UCC could revolutionise this situation, fostering an environment of gender justice. It would be a firm step towards ensuring that all citizens, regardless of their gender, have equal rights, which is critical for societal stability.

Simplifying the Legal System

?A Uniform Civil Code could greatly simplify the legal system by providing a single set of laws that are clear and easy to understand. This clarity could decrease legal ambiguities, making the legal system more approachable and ensuring citizens are well-informed about their rights and duties. This could prevent the exploitation of legal loopholes and contribute to societal peace.

Fulfilling Constitutional Mandates

The Constitution of India calls for the enactment of a UCC, Article 44, part of the Directive Principles of State Policy, states that the State shall strive to secure a UCC for its citizens. By implementing the UCC, we are upholding our constitutional commitments and preventing any misuse of the law under the guise of personal laws.

Addressing Potential Concerns

While arguing for the UCC, it's crucial to consider and address challenges related to religious freedom, cultural diversity, majoritarianism, and practical issues in drafting and implementing the UCC.

Respecting Cultural Diversity and Religious Freedom

In advocating for the UCC, I firmly believe the code should respect the country's cultural and religious diversity. The UCC should neither infringe upon individual religious freedoms nor impose a uniform set of norms that could be seen as oppressive.

Avoiding Majoritarianism

It's crucial to ensure the UCC doesn't simply reflect the norms of the majority community. Open, inclusive consultations are needed to ensure the UCC incorporates progressive values from all communities, preventing any bias towards majority rule.

?As a strong supporter, I believe the Uniform Civil Code is a powerful tool for societal transformation and urgent reform needed to unify the nation, establish gender justice, simplify the legal system, and fulfil constitutional mandates. Implementing the UCC requires careful, inclusive, and sensitive dialogue, committed to creating a code that balances the aspirations of India's diverse society while preventing the potential misuse of personal laws.

Yes it is high time to be implemented, UCC. Then only prudent affective implementation of justice to all without any deviations out of cast / creed. One nation one uniform civil code. We strongly propose in the better interest of our society. Jai Bharat.
