Process Serving + DebtCol Software

The proper service of process is one of the most important components of the legal process. If service is not proper, then any post judgement recovery action taken to secure an outstanding debt may be compromised costing you time, money and reputation.

In some cases, where personal service is required, Defendants evade service and in those circumstances, evidence can be produced by way of an Affidavit/s in Support of a Notice of Motion for Substituted Service for a Court to decide whether service can be effected in some other way. The evidence required for any Registrar or Judge to make such a determination includes two key ingredients:-

1)     If documents were left at an address would they be brought to the attention of a Defendant

2)     How long would it take for the documents to be brought to the attention of a Defendant.

In some cases, evidence is not restricted to just a process server or other person attempting service. Evidence could extend to a Credit Manager or Debt Collector and any other party involved prior to or after the documents have being filed and issued for service. This evidence may contribute to evidence to support the fact a Defendant lives or works at a particular address or provide vital information to assist a Court make a determination as to whether an Order for Substituted Service will be granted.

In all cases, whether you are a Credit Manager, Debt Collector or Field Agent, making detailed notes on all attempts and communication including phone calls, SMS and emails is important and could make the difference in obtaining a successful outcome with respect to securing proper service.
