The modern era of privatized prisons in the United States began in the 1980s, coinciding with the War on Drugs and a significant increase in incarceration rates. To address overcrowding and reduce costs, governments turned to private companies to build and manage prisons. By 2018, approximately 8.41% of prisoners in the United States were housed in private prisons. In 2021, an executive order aimed to reduce the federal government's reliance on private prisons, but the majority of private prison contracts are at the state level, limiting the order's impact (Bureau of Justice Statistics, 2020).
Cost-Effectiveness
Proponents of privatized prisons argue that they offer cost savings through efficiencies inherent in private sector operations. However, studies have produced mixed results regarding these claims. Some research indicates that private prisons may not be more cost-effective than public facilities. For instance, a study by the U.S. Bureau of Justice Statistics found that the anticipated cost savings from private prisons "have simply not materialized." Additionally, private facilities often engage in selective practices, such as accepting only low-risk inmates, which can skew cost comparisons (Vera Institute of Justice, 2017).
Safety and Conditions
Concerns about safety and living conditions in private prisons have been prominent. Reports suggest that these facilities may have higher rates of violence and inadequate staffing. For example, a nationwide study found that assaults on guards by inmates were 49% more frequent in private prisons than in government-run prisons, and assaults on fellow inmates were 65% more frequent (Urban Institute, 2019).
Specific incidents further highlight these issues. In Australia, the Parklea Correctional Centre, managed privately, experienced numerous issues, including murders, riots, and contraband smuggling. These problems led the New South Wales government to announce that the facility would return to public management by October 2026. This decision reflects a broader reevaluation of the efficacy and ethics of privatized prison management.
In the United States, CoreCivic, a leading private prison company, has faced significant legal challenges. Since 2016, the company has settled over $4.4 million in claims alleging mistreatment, including 22 inmate deaths, in its Tennessee facilities.
