Prevention of Scratches to Healing

We are all aware of the term PoSH (Prevention of Sexual harassments)

And we all know about the rules and regulations according to our world :-

The United States of America


In the United States, a complainant has several legal choices, including mediation, filing with the Equal Employment Opportunity Commission (EEOC) or bringing a claim under a state Fair Employment Practices (FEP) Act (both for workplace sexual harassment), or filing a common law tort. Not all cases of sexual harassment will be regarded severe enough to warrant a judicial action. However, the majority of the time, multiple forms of harassing behaviors are present, and there is no legal minimum for harassing conduct. A sexual harrasment victim frequently lacks a strong legal case against the perpetrator. Few cases ever make it to federal court as a result of this, as well as the general propensity for settlement.


The United Kingdom


The 1975 Discrimination Act was amended in 1986, and sexual harassment was recognised as a form of discrimination. Harassment is defined as unwanted sexual conduct or behaviour based on a person's sex that has the consequence of infringing on their dignity. It is also harassment if an employer treats someone less favorably because they have rejected or consented to either of the forms of harassment outlined above.


Australia


Sexual harassment is defined by the Sex Discrimination Act of 1984 as “unwanted sexual behaviour in circumstances where a reasonable person, having regard to all the circumstances, would have expected the harassed person to feel offended, embarrassed, or frightened.”


France


“The reality of harassing anybody using instructions, threats, or restraint, in order to seek favors of a sexual character, by a person misusing the authority that functions confer on him,” is described as sexual harassment according to Article 222-33 of the French Criminal Code. This indicates that the harasser must have authority over the harassed (essentially, sexual harassment cannot occur between coworkers of the same rank). Moral harassment, on the other hand, occurs when an employee is subjected to repeated acts (one is not enough) with the intent or effect of degrading (deteriorating) their working conditions, which may jeopardize their rights and dignity, affect their physical or mental health, or jeopardize their professional future.


Pakistan


Pakistan has passed a Code of Conduct for Gender Justice in the Workplace, which would address issues of sexual harassment in the workplace. The Alliance Against Sexual Harassment in the Workplace (AASHA) stated that they will collaborate with the committee to develop standards for the proceedings. Sexual harassment is defined by AASHA in a similar way to how it is described in the United States and other cultures.


Hong Kong


To safeguard service providers against sexual harassment by their customers, an amendment to Hong Kong's Sex Discrimination Ordinance has been proposed. It is illegal for a service provider to sexually harass a customer while giving or supplying products, facilities, or services under existing legislation. However, the law does not prohibit a client from sexually harassing a service provider. This would protect all persons in all the service sectors in Hong Kong.

India - National Commission for Women has asked the government to ensure constitution of Internal Complaints Committee (ICC) in accordance with Supreme Court guidelines in its departments, institutions and autonomous bodies to address such cases.It has also recommended conducting gender sensitisation workshops for top level management officials. NCW recommended publicizing committee using posters,etc. and explicitly mention the contact details of the members. The commission also highlighted the need for orientation programs for employees to sensitize them on sexual harassment. Another recommendation was to enhance communication strategies to combat violation against women. The rules for the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 have come into force on 9th Dec,13'

We are all aware of the laws in the work place and personal lives too!

We all are aware of good touches and bad touches too!

Still cases happen in the society and workplace also!

Now the Question is Why?

In the workplace it is understandable that it happen due to power struggle and greed to move up in the hierarchy or to get a better pay scale or to save the colleague they have best bonds with they put allegation on another colleague!

It is also understandable that we need to be careful about the words we say! And how it comes across! We also need to be careful about the eye movements and gesture and postures!

And we all know about the consent part too! (This applies for every gender in the world)

We should always remember an organization is the better picture of the society we live in!

We all can follow few steps while on social media or in life:-

  1. Don't reply after a certain hour so that people can not take advantage of that!
  2. Never allow anyone to take pictures or videos of your private parts without consent.
  3. Never allow anyone to take advantage of a situation even if you are in a crowded space to take advantage of the situation.
  4. Always make sure you are wearing decent cloths When you are at video call or else always remember people can take advantage of that! Until you have other plans :p (Screenshots are more dangerous than atom bombs these days).

5. Never believe the half hearted story from any person including me without checking facts.

6. Scratches of individuals due to their past or present events in their personal and professional life can make them make baseless allegations on individuals so you need to cross check facts.

7. Always remember sense of humor and jokes are only jokes! (Either you enjoy it or else you don't enjoy it, If the joke is not according to your taste then you can leave the uncomfortable situation until it's too personal{Will Smith Case}) If You are creating issue out of it then you are in the wrong direction and need to heal your scratches.

At last I just want to say as a student of psychology who have keen interest in this topic is that

'We as a student of psychology have always been taught to remove the previous scratches people have! And not to disclose one case to the other person or mix two cases and have the same conclusions as we hear similar kind of stories each and everyday which might affect our own mental health and inner peace too!

Never let that happen. Never take too much cases and jumble up cases!
