The truth? It depends on your specific situation.

In Florida, like many states, disclosing any material defects that could impact your property's value is crucial. This means hidden issues that wouldn't be readily apparent during a viewing. Failure to disclose such issues when you're aware of them can lead to legal trouble down the road if the buyer discovers them later.

Here's the crux:

  • Pre-Listing Inspection: If you choose this route, be prepared to address any major issues the inspection reveals or disclose them to the buyer. This might not be ideal if repairs are beyond your budget.
  • No Pre-Listing Inspection: If you skip the inspection and only disclose known issues, you're generally okay (as long as you weren't aware of hidden problems). However, if major issues like foundation problems surface later, you'll be obligated to disclose them then.
