Lien resolution takes a lot of experience and patience, here is a recent example we would like to share:
Prior to settlement, a workers' compensation case indicated no claims paid by Medicare. The case was settled and final settlement documentation was submitted to Medicare to close the case.
Months later, a final demand was issued stating $23,000 was owed to Medicare. Medicare went on to say that the no claims paid letter was generated in error and that they had identified claims related to the date of incident. By the time Specialty Allocations was requested by the customer to assist on the case, the lien amount was in the process of being deferred to the Department of Treasury. Once Medicare defers the case to the Department of Treasury it typically can no longer be disputed, unfortunately.
We discussed the case with our client in depth and everyone was in agreement to pay the $23,000 and we submitted a redetermination appeal as soon as possible as many of the claims were not related to the date of incident. The redetermination appeal prevented our client from having to pay accrued interest. After Medicare reviewed our redetermination appeal, they removed the claims and completely refunded our client the $23,000!
