I was working through a key contractual provision session with a 1:1 Strategy client last week. We were hyper focusing on “Changes to Your Work” provisions.

I shared with him that when Owners start sidestepping the GC on a project and directing subs directly, it is a giant flashing neon sign that the project will end up in litigation and there are strategies that a sub should immediately implement to safeguard themselves from the inevitability of a lawsuit down the line.

I know this because every time an owner has done this to one of my subcontractor clients, there’s been a lawsuit filed within 1 year of COO.
