The Military Secretary (A),
Nigeria Defence Headquarters,
Abuja.

Dear Sir,

PETITION

PETITION FOR INVESTIGATION OF BRIG. GEN. ALIYU MOMOH INVOLVEMENT IN ALLEDGED VIOLATIONS OF THE CONSTITUTION IN THE CONDUCT OF THE JUNE 21ST 2014 EKITI STATE GUBERNATORIAL ELECTION DEROGATORILY KNOWN AS (EKITIGATE)

With humility, I have the authority of the governing board of the above named civil society organization to intimate you with this body which is primarily focused on entrenching democratic ethos into our body polity through civilized and legitimate engagements for the sake of peace, justice and progress.

Sir, we are very much disturbed that a sore point and recurring decimal of our democracy is the biased, unprofessional and compromised conduct of constitutionally empowered institutions in the discharge of their statutory functions for the conduct of free, fair and credible elections. The Committee for the Protection of Peoples Mandate (CPPM) frowns at this repeated and flagrant violations of our electoral laws without appropriate sanctions as stipulated by the electoral Act and for us, this is unacceptable.

We wish to bring to your attention for urgent action, the alledged complicity of Brigadier General Aliyu Momoh, Commander of the Nigerian Army’s 32nd Artillery Brigade and others in the violations of the Electoral Act in the conduct of the June 21st 2014 Ekiti State Gubernatorial elections now derogatorily referred to as Ekitigate as widely reported in the media following a voluntary confessional statement by Captain Sagir Koli. (See Premium Times, February 6, 2015).

By alledgedly compromising the credibility of the conduct of the Ekiti State gubernatorial elections held on June 21st, 2014 for pecuniary gains, Brigadier General Aliyu, not only violated the constitution and the oath of his commission, but has subjected the image and integrity of the Nigerian army to public ridicule and international opprobrium.

By his alledged misconduct in connivance with cohorts, in criminally subverting the conduct of free, fair and credible elections, Brigadier General Aliyu Momoh has succeeded in damaging the psyche of the Nigerian people in entrusting the Nigerian military to play its constitutional role, professionally and unbiasedly.

Therefore, in the light of the above, we demand the following:

1. Immediate investigation of the complicity of Brigadier Aliyu Momoh and other military officers in the violations of the Electoral Act and constitution in the conduct of the Ekiti State Gubernatorial election of June 21st, 2014.
2. Immediate suspension of the commission of Brigadier Aliyu Momoh and others, pending the outcome of the investigation.
3. The outcome of the investigation must be made public
4. The indicted officers must be submitted to the Nigeria Police for prosecution to serve as a deterrent to others.

Sir, we are very much interested in contributing our quota towards the building of a Nigeria of our dreams as envisaged by our founding fathers, by ensuring that every national institution, strictly adheres to its constitutional functions to the latter and the Nigeria military which is supposed to epitomize discipline, courage, professionalism and character must be above board in its public conduct.

We look forward to your prompt consideration and action on this issue.

Thanks.

Yours Faithfully,
Signed.
Nelson Ekujumi,
Executive Chairman.
