Québec Government Introduces Long-Awaited Bill 69 to Modernize Energy Legislation
After several months of anticipation, on June 6, 2024, the Minister of Economy, Innovation and Energy tabled Bill 69 - An Act to ensure the responsible governance of energy resources and to amend various legislative provisions (the "Bill"). The Bill amends several energy-related laws and regulations, including the Act respecting the Régie de l'énergie and the Hydro-Québec Act, with the aim of providing Québec with the flexibility and tools it needs to achieve its energy transition and carbon neutrality objectives by 2050 while driving economic development.??Read more

Ontario Court Dismisses Failure to Warn and Negligent Manufacture Claims Against Defendants in Leaky Dishwasher Case
In Pelton v Maytag, 2024 ONSC 3016 the Ontario Superior Court of Justice ruled that the defendant manufacturers were not liable for failing to warn consumers that the product could fail because of a “freezing event” and did not establish a manufacturing defect claim. In dismissing the plaintiff’s product liability claims, the Court offers guidance regarding a manufacturer's duty to warn of remote or unforeseeable risks, and the evidentiary standard involved in establishing manufacturing defect claims. ??Read more

OSC Addresses Use of Cash Collateral for Delayed Basket Securities in ETF Subscriptions
The Ontario Securities Commission recently published OSC Staff Notice 81-735 Cash Collateral Use for Delayed Basket Securities in ETF Subscriptions regarding the use of cash collateral for ETF in-kind subscriptions where one or more securities from a basket of securities comprising payment cannot be delivered on the settlement date. OSC staff are of the view that this practice is permitted under National Instrument 81-102 Investment Funds, provided that certain conditions are met.??Read more
The End of CDOR: June 28, 2024
On June 6, 2024, the Ontario Securities Commission, Autorité des marchés financiers, British Columbia Securities Commission and Alberta Securities Commission published CSA Multilateral Staff Notice 25-312 Reminder of Cessation of CDOR on June 28, 2024. The Staff Notice reminds market participants that the Canadian Dollar Offered Rate will cease to be published after June 28, 2024.??Read more
