The 2024 legislative session has seen an immense amount of activity in the Prescription Drug Affordability Board policy arena. 17 states introduced legislation to create a Board with the power to conduct affordability reviews on some of the most expensive pharmaceutical products in the country. Currently, 11 are left standing.?
The bills gaining the most attention can be found in the legislative chambers of Connecticut, Michigan, and Vermont. Connecticut SB 8 and Michigan SB 483 each seek to create a PDAB with the full ability to set upper payment limits, while Vermont’s SB 98 tasks an existing agency with analyzing Rx affordability initiatives, including the PDAB approach, and recommending the best course of action.?
Other states seeking to create a PDAB with upper payment limit authority include Arizona, Illinois, Rhode Island, Massachusetts, and South Carolina. Alternative PDAB approaches can also be found in the legislative chambers of New Jersey, New York, and Pennsylvania.?
