CLAR: THE PRACTIONERS GUIDE TO THE NEW WORLD OF PROMPT PAYMENT AND LIENS (or life with 28 day payment schemes)
Construction Lien Act Reform (CLAR) is set to become reality in late 2017. CLAR will fundamentally change the way construction business is conducted across Ontario as it will introduce Prompt Payment and efficient dispute adjudication. CLAR will dramatically improve the overall business climate for all stakeholders (particularly trade contractors, who are the last, and longest waiting, party to be paid). But the changes will likely create short-term havoc and uncertainty, so come and gain the practitioners guide to this new world order.

Jim LeBer; Partner, Advocates LLP
Jim is a noted expert in Construction Law and Arbitration, and has practiced law since 1983. In 2004 Jim became one of the few lawyers based in Southwestern Ontario to be Certified by the Law Society as a Specialist in Construction Law. Additional to his practice, Jim has taught courses in Construction Law for both the Ontario General Contractors Association Gold Seal program and at Fanshawe College in London.
Lianne Armstrong; Partner, Lerners LLP
Lianne has over 30 years of experience as a lawyer, specializing in Construction Law, Construction Lien Disputes, and Construction Deficiencies & Breach of Contract Disputes. Amongst her many achievements, Lianne is the President of the Middlesex Law Association (2014-present).
Paul Martin; Director of Business Operations, Western University
Paul is a CPA, who is responsible for the smooth running of Human Resources, Finance, Budgeting and IT within Facilities Management at Western University Canada. Paul has been with WU since 1993. Paul has played a key role in developing WU’s approach to construction and procurement of construction services towards Best Value.
Scott Chatterson; Project Manager, Ellis Don
Scott joined EllisDon in 1999 from Fanshawe College. He possesses extensive project management knowledge working in sectors involving data centres, CL2 and CL3 laboratories, low-level nuclear storage, retail spaces, and casinos. A notable role Scott has taken on was being Project Manager on a LEED Platinum-awarded data centre. One of his more recent projects is the Interdisciplinary Research building at Western University.
John Rasenberg; President, J.M.R. Electric Ltd.
John founded and built J.M.R. Electric into a large, successful and well respected contractor. John is very involved in an industry leadership role with the Canadian Construction Association (CCA), serving as the LDCA representative and on the CCA’s Board of Directors. Additionally, John, as part of a select committee, is working with the Federal government to help them implement Prompt Payment.
Note: Paul, Scott and John will collectively speak to the effective business relation they have.
The Moderator for this forum is:
David Swift; Lawyer, Partner; Advocates LLP
David’s practice focuses on secured enforcement and other insolvency matters, as well as on construction and other commercial litigation matters. Suppliers and general contractors retain him to help resolve various construction-related problems. David has prepared several papers and has been presented on construction lien and insolvency topics. David is currently a Director of the LDCA.
