Part 9: Tribunal Hearing

The Tribunal hearing may take place in the tribunal building, they can also take place online by video.

The Tribunal hearing is chaired by an Employment Judge who is legally qualified and sometimes accompanied by two other members i.e. often experts in their respective industries, preside over the proceedings.

Parties can represent themselves at a hearing or they may choose to be legally represented.

After both parties have made opening statements setting out their case, as a general rule, the Claimant and their legal representative begins with presenting the claim and evidence. The employer's legal representative then has the opportunity to cross-examine the claimant and their witnesses, probing the claim with questions. Throughout this process, the Judge and other members may intervene, seeking clarity or additional information.

Witnesses from both sides are also called upon to give evidence, adding depth to the case. Once all evidence has been heard, both parties have the chance to deliver their closing submissions, summarising their positions and arguments. Navigating tribunal proceedings can be complex, which is why many seek Counsel to assist.

The tribunal will adjourn the hearing to make a decision, this may be given orally on the same day, or a written decision may be sent out to the parties at a later date.
