Over £106,000 for employee who believes transgender women can not change their sex away from male.

Tax policy specialist Maya Forstater has been awarded over £106,000 after successfully arguing that her contract non-renewal by a think tank was partially driven by her belief that an individual's biological sex is unchanging meaning that #transgender women could not change their sex away from male.

A recent #employment tribunal judgement revealed that if Forstater had not made comments perceived as anti-transgender on Twitter in 2018, there would have been a 20% likelihood that the Center for Global Development would have extended her fellowship.

Forstater's 2021 successful appeal established her "gender critical" stance, the view that transgender identity is not legitimate, as a philosophical belief meriting legal protection under the Equality Act.

In a statement released on Friday, Forstater asserted that her experience should serve as a warning to employers who may face significant damages in cases involving discrimination against individuals holding beliefs about the reality of biological sex.

The case of Forstater v Center for Global Development Europe has been seismic to say the least, and the resulting judgement is something that all employers and business owners should pay attention to.

Forstater expressed a sense of closure and vindication from the final judgement and noted the clarity it brought to the allegations suggesting she might have engaged in harassment or discrimination, which she says were unfounded.

The Center for Global Development stated on Friday that the resolution of Forstater's claim allows it to refocus entirely on its economic research. The think tank, based in Washington, D.C., and #London, reiterated its commitment to fostering a work #environment that is inclusive, safe, and welcoming to all.

The center, its European subsidiary, and its president, Masood Ahmed, are jointly liable for £99,625 of the awarded amount, while the remainder is payable by the center and CGD Europe.

Forstater's fellowship was not renewed by the center after she authored articles and tweets that were critical of transgender people and their identities. She contended that her statements, which included phrases such as "trans women are male" and "woman means adult human female," were not transphobic.

In 2019, the Employment Tribunal initially ruled that Forstater's views were absolutist and not deserving of respect in a democratic society, as they cultivated a hostile environment for transgender people. However, this decision was overruled in 2021 by an appeals court.

Employment Appeal Tribunal Judge Akhlaq Choudhury stated in his June 2021 ruling that a philosophical belief would have to be akin to Nazism or totalitarianism to be deemed unworthy of protection. He also cautioned that those with gender-critical beliefs should refrain from gratuitously referring to trans persons in terms that contradict their chosen identity, as such conduct could potentially constitute harassment or discrimination, depending on the circumstances.
