One of the crucial provisions outlined in Section 15 of the Customs Act pertains to the prohibition and restriction of importing and exporting goods bearing counterfeit trademarks or false trade descriptions. This move aligns with the provisions of the Penal Code of 1860 and the Trademarks Act of 2009.

Section 15 also addresses goods manufactured or produced outside Bangladesh bearing names or trademarks falsely indicating Bangladeshi origin. The law mandates that such goods must clearly demonstrate their foreign origin, including the country of manufacture, conspicuously.

Goods imported from abroad are also scrutinized for any infringement of design copyrights under the Patents Act of 2022. Any fraudulent replication of registered designs is subject to confiscation unless used with the appropriate licensing or consent.

Furthermore, goods produced outside Bangladesh that violate the Copyright Act of 2023 or infringe upon layout designs of integrated circuits are not spared. Such items intended for commercial use within Bangladesh face strict penalties.

Under Section 17 of the Customs Act, provisions are made for the detention and confiscation of goods found to be in breach of the Section mentioned above 15. This ensures swift action against any attempts to flout intellectual property regulations.

Incorporated within Clause 9 of Section 156(1) of the Customs Act are penalty provisions for any infringement of intellectual property rights (IPRs). Individuals involved in the violation of IPRs concerning imported or exported goods are subject to severe penalties. These penalties may include confiscation of the goods and fines up to twice the value of the confiscated items.

In conclusion, Bangladesh Customs is playing a pivotal role in safeguarding intellectual property rights within the nation's borders. Through stringent enforcement mechanisms and penalty provisions, the customs authorities are sending a clear message: violations of TRIPS provisions will not be tolerated. As Bangladesh continues to strengthen its stance on intellectual property protection, it reinforces its commitment to fostering innovation and creativity within its borders.
