  • Contractual Missteps: Many organizations face compliance issues due to restrictions in their ULA contracts regarding usage, territories, legal entities, or public cloud environments.

Performing a thorough licensing assessment is crucial for several reasons:

  • Remediate Issues: You can avoid costly penalties by identifying and addressing compliance issues early. Most organizations prefer remediation over procuring additional licenses, especially when the software isn’t essential to their operations.
  • Negotiate with Confidence: If your licensing assessment shows that you’re fully compliant, you can negotiate with Oracle. You can confidently reject any renewal offers that don’t reflect the true value of your ULA.
  • Prepare for Certification: The assessment forms the foundation for the certification process, enabling you to submit a precise license report to Oracle at the end of your ULA. This is a contractual obligation; getting it right is essential to avoid future complications.

2. Post-Assessment Actions: Maximizing Your ULA:

Once the licensing assessment is complete, the next step is to maximize the value of your ULA. This involves deploying as much ULA-covered software as possible before your ULA ends.

The reason is simple: Oracle support costs remain fixed regardless of the number of licenses you certify, so it’s in your best interest to certify as many as possible.

Benefits of Maximizing Your ULA Licenses:

  • Future-Proof Your Licensing Needs: You create a buffer for future requirements by certifying more licenses. For example, I’ve worked with clients who initially had 500 licenses but could certify 5,000 by strategically deploying additional software before the ULA ended. We refer to this as ULA maximization.
  • Mitigate Future Compliance Risks: A larger pool of certified licenses helps protect against future non-compliance. Remember, a single Oracle Database Enterprise Edition (DB EE) processor license is valued at $47,500. Certifying 100 additional licenses, for instance, equates to $5 million in license value, providing significant protection and flexibility.

Deployments on VMware and What Happens When the ULA Is Certified:

Organizations that deploy Oracle products on VMware or other virtual platforms often worry about what happens once their ULA ends and the unlimited license option is no longer available. The concern is valid, but it’s important to note that if ULA were the only solution, every large organization would have one. Some contractual strategies allow you to certify your ULA while continuing to run on VMware or other virtual platforms compliantly.

No, your support fees will remain fixed regardless of the number of licenses you certify. Only the standard annual increase, typically around 8%, will apply.
