Court hearing.

Dear colleagues, clients, candidates and supporters,

As all of us Recruitment Companies well aware, there are clients around, who prefer to use our services and not pay for it.

We all know how frustrating and unfair it feels to find out that after clients' refusal of the candidate, it comes to our knowledge, these Candidates have in reality been employed and worked for a client since the date of introduction by the agency.

We at the moment have one court hearing coming very soon for the case of breach of our contract, employment of our candidate and not willing to let us know or pay our fees.

It is a lengthy and expensive exercise of presenting ourselves and the whole idea of recruitment in front of the jury.

We decided to do it not only for ourselves, but for the whole society of household recruitment companies in United Kingdom.

We believe that we have all proof of this deceitful action by our clients , a low company in this case, which makes it even more distasteful and unprofessional from our point of view.

We will let #DEMA and #ANA know the date of this court hearing and will be very grateful to every household recruitment company who will come to support us and may learn a lot about the way of securing and protecting our work, our integrity and our employees.

I trust, we all should stay together in the occasion of disrespectful and dishonest treatment by the clients.

It does happen very rarely and we all have worked for polite, fair and appreciative clients. We all love what we do. We are trying to show integrity, passion and care day after day. And we all deserve to be rewarded for that.

I wish you the best, and as a PSP please let me know if I can be of assistance. I feel this goes to the heart of character, integrity and honor. If any principle would treat an agency in this manner, then they will have no qualms about treating me ( the new hire PSP) this way. I do not want this type of relationship and reputation for myself. Just as if I were the principle, I would not want to hire a PSP that would knowingly and willfully engage in this dishonest action. If they will cheat the agency, they will cheat me.

Good luck, like yourselves we had rare occassions this happened. I found it difficult that the parents wished me to work to help them source a nanny so they could go to work . Then felt it was ok to expect me to not get paid and earn a living as they do. The nannies are at fault too as they should always let the agency know if they have been asked to not tell you. After all many of them rely on the support and experience of a good agency. It is about being respectful in life to one another. All the best.

In the USA - we have regretfully had to do the same thing. Here, it all boils down to "proximate cause" or "the but for- rule". If the client would not have known of this candidate "but for" your introduction at that time, then you are due the fee. -- What can we do to support you? And are there provisions you can enforce on the candidate side when this comes up as well? We tried to do this a few years ago with our candidate agreements/applications, but it has fallen aside as we now do most of our recruiting online and not in the office with fill out applications like in the old days. I think the candidates are also to blame and there should be some recourse when they take jobs which an agency has made available to them behind the agency's back. The amount of compensation would obviously not be as great, but we do a lot of work on the candidate side as well and to have them fully disregard our value in putting them forward is so disappointing.
