Offences under the New Cybercrime Law in the UAE – Do’s and Don’ts

The UAE’s national #cybercrimes #legislation 2012, has been abrogated and replaced by Federal Decree-Law No. 34 of 2021 Concerning the Fight Against Rumors and Cybercrime (the New Cybercrimes Law).
The New Cybercrime Law imposes a #penalty on the manager of a #company for #commission of a cyber #offence while being in charge of a company and when their actions amount to #breach of #duties from a cybercrime standpoint. #Fines are also imposed on individuals and #entities that fail to adhere to an order of removal or block #content within the scope of the New Cybercrime Law.
The #penalties under the New Cybercrime Law is clearly defined and includes different sanctions based on the sectors such as #finance, #entertainment and #media, #science and #technology, #health etc. Penalties for cyber #hacking in such industries can range from AED 500,000 to AED 3,000,000 including #imprisonment.
Under the New Cybercrime Law, it is a criminal offence to collect, store and process personal data of individuals residing in the UAE and supplements the UAE’s personal data protection law which was also recently passed. Such an offence can result to a 6 month imprisonment and fines ranging from AED 20,000 to AED 100,000.
In addition, spreading false information is also another #punishable offence under the New Cybercrime Law. ?Such information is neither #limited to false information nor to #information that harms the state. There appears to be a particular #focus on misinformation and #fake news on social media. The offence carries a #prison sentence of at least one year, and a fine of up to AED 200,000.
