NZ LLP

To all my LinkedIn contacts,

The summer holidays in New Zealand are over and everybody is back to work or school. We have been actively at work for a few weeks by now. It has been relatively quiet in our industry. Most of our colleagues seem to be involved especially in second passports and new residency. As you know, we can also assist with these requirements.

However, we noticed that, in our more traditional business, there is a demand for new structures. Besides, companies, trusts and foundations we can also assist our clients with the creation and management of Limited Partnerships (LP). LP’s are interesting in New Zealand as the LP, while filing annual returns and accounts, do not pay tax in New Zealand. Tax is payable by the Partners in their country of establishment.

LP’s must be registered with the New Zealand IRD but their registration details are not available to the outside world. Tax returns are not published anywhere. In the past this was a reason for us not to use LP’s. NZ Foreign trusts did not need to file a tax return. Under the new law they must also file accounts and the administrative benefit is no longer available. Consequently, our international clients can chose between LP’s and Foreign Trusts. It is up to them and their advisors which way they want to go. Either way, we are available to help.

With kind regards,

Nico Francken
